A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS &
RECOMMENDING TO THE CITY COUNCIL, DENIAL OF A REQUEST
FOR A 12 MONTH EXTENSION FOR TENTATIVE MAPS 5075 TO
ALLOW FOR DEVELOPMENT OF 189 UNITS ON 43 ACRES OF LAND,
GENERALLY LOCATED AT THE SOUTHEAST CORNER OF DEEP CANYON
& AVENUE 44.

WHEREAS, the Planning Commission of the City of Palm Desert,
did receive a verified application from M.B. Johnson/Interstate
Properties, Inc., requesting a 12 month extension of a tentative
tract on 43 acres of land, located in the R-1 zone and situated
at the southeast corner of Deep Canyon and Avenue 44, more
particularly described as:
Assessor's Parcel No. 625-050-01, -02, -03, -05,
-06, -12, -13, -14
625-100-01, -02, -03
WHEREAS, said application had complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure
Resolution Number 74-14", in that an Environmental Assessment
form was submitted and a Negative Declaration was made by the
Director of Environmental Services and the appeal period has
expired, and;
WHEREAS, the Planning Commission did take into consideration
the Tentative Map as submitted, and the reports of the various
reviewing agencies, and;
WHEREAS, the Planning Commission did find that the subject
Tentative Map does not substantially comply with the City of
Palm Desert Code (County Ordinance Number 460), and the State
of California Subdivision Map Act, as amended:
WHEREAS, the Planning Commission did find that 1) the pro-
ject does not comply with the adopted General Plan in that it
does not present methods of preservation of the date grove
appearance; 2) the project does not comply to the existing
or proposed zoning ordinance in that there is insufficient
parking and a shortage of usable open space; 3) three years

have expired since the original tract map was presented and
conditions have changed sufficiently to warrant a new develop-
ment plan for this area; and
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Palm Desert as follows: 1) that the above
recitations are true and correct and constitute the findings
of the commission in this case; 2) that it does hereby recommend
denial to the City Council of the City of Palm Desert of the
above described Tentative Map No. 5075.
PASSED, APPROVED and ADOPTED at an adjourned meeting of the
Palm Desert Planning Commission held on the 6th day of October,
1975, by the following vote, to wit:
