HomeMy WebLinkAboutRes No 097PLANNING COMMISSION RESOLUTION NO. 97 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA RECOMMENDING APPROVAL TO THE CITY COUNCIL OF ARTICLE 25.46 OF THE PALM DESERT MUNICIPAL CODE WHICH PROVIDES FOR A ZONING MAP FOR THE CITY OF PALM DESERT. ZONING ORDINANCE AMENDMENT-04-75. WHEREAS, the Planning Commission did on the 18th of November, 1975, hold a duly noticed Public Hearing to consider adoption of Article 25.46 of the Palm Desert Municipal Code, known as the zoning map, attached hereto and labeled Exhibit A, plus any changes to said attachment, labeled Exhibit B, filed by the City of Palm Desert; and, WHEREAS, said application has complied with the require- ments of the "City of Palm Desert Environmental Quality Pro- cedure Resolution Number 74-14", in that a final Environmental Impact Report was presented at a duly noticed Public Hearing held September 29, 1975, and said report was recommended to the City Council for certification as a final Environmental Impact Report; and, WHEREAS, at said public hearing, upon hearing and con- sidering the testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the approval of Article 25.46 necessary to carry out the goals and ob- jectives of the Palm Desert General Plan: 1. The project does conform to the adopted Palm Desert General Plan and all the provisions of the State Planning and Zoning Law (California Government Code). 2. The project does ensure the protection of the public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1) that the above recitations are true and correct and constitute the findings of the couuuission in this case; 2) that it does hereby recoiiuiiend approval to the City Council of Article 25.46 of -2- Resolution No.97 the Palm Desert Municipal Code, also known as the Zoning Map, for the reasons set out in this resolution, PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission, held on the 18th day of November, 1975, by the following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: ATTEST: PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 97 Exhibit "B" MAP 1S 1. The northwest corner of 44th Avenue & Fairhaven Drive, the area between Parkview Drive and the Palm Valley Channel was desig- nated as R-1. 2. The north side of Catalina Way, between San Pasqual and San Pablo was designated as R-1-10,000. 3. The area easterly of Portola Avenue at Catalina Way, all the way to Deep Canyon Road was designated as PR-5. 4. The northeast corner of Deep Canyon Road and Highway 111 to the eastern City limits was designated as Planned Commercial (4), S. P. 5. The northeast corner of Las Palmas and the alley to the north be designated as R-3. 6. That the area between Larrea and Shadow Mountain Drive, west of Portola Avenue, one lot deep west be designated as follows: The northerly half - C-1; and the southerly half to remain as R-3-20,000 (3). MAP 2S 1. Silver Spur Trail on the northerly side be changed from R-2-8000 to R-1. 2. Designation of the S.P. zone on both sides of Highway 74 at least two lots deep or 300 feet deep in a subdivided area. 3. All RE designations at less than 40,000 square foot lot minimum be changed to R-1. MAP 4S No Changes other than technical corrections.
