HomeMy WebLinkAboutRes No 099Note Nme PLANNING COMMISSION RESOLUTION NO. 99 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING DENIAL TO THE CITY COUNCIL OF A REQUEST FOR A CHANGE OF ZONE ON 2.23 ACRES from R-3-7000 to R-3-3000 AND R-3-5000 ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF PARKVIEW DRIVE BE- TWEEN FAIRHAVEN ROAD AND THE PALM VALLEY CHANNEL. CASE NO. C/Z 01-75. WHEREAS, the Planning Commission did on October 6 and December 2, 1975, hold a duly noticed public hearing to consider a Change of Zone application filed by RMW of the Desert, from R-3-7000 to R-3-3000 and R-3-5000 on property generally located on the south side of Parkview Drive, between Fairhaven Road and the Palm Valley Channel; and more particularly described as: Assessor's Parcel No. 621-320-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Assessment form was submitted and a Negative Declaration determination was made by the Department of Environmental Services and the appeal period has expired; and WHEREAS, said public hearing was continued from October 6, 1975, and upon hearing the testimony and arguments, if any of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the denial of R-3-3000 and R-3-5000 zoning necessary to carry out the provisions and general purpose of County Ordinance Number 348 (adopted by reference): 1. The request is not consistent with the goals and policies of the Palm Desert General Plan. 2. Approval of the request would not help insure public health, safety andgeneral welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case; 2) That it does hereby recommend denial to the City Council of the requested Change of Zone from R-3-7000 to R-3-3000; 3) That it does hereby also recommend denial to the City Council of a change of zone from R-3-7000 to R-3-5000 for the reasons set forth in this resolution. RE lution No. 99 PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning Commission held on the 2nd day of December, 1975, by the following vote, to wit: AYES: Commissioners MULLINS, WILSON, SEIDLER NOES: Commissioners BERKEY and VAN DE MARK ABSENT: None ABSTAIN: None ATTEST: C-1-31L\\ PAUL A.
