HomeMy WebLinkAboutRes No 105PLANNING COMMISSION RESOLUTION NO. 105 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF 2 BUSINESS IDENTIFICATION SIGNS ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF HIGHWAY 111, WEST OF SAN PABLO. CASE NO. 14C. WHEREAS, the Planning Coiuuiiission of the City of Palm Desert did receive a verified application from the VILLAGE BOOTLEGGER requesting approval of two business identification signs on property located in the C-P-S Zone, and situated on the north side of Highway 111, west of San Pablo; the property being more particularly described as: 73-640 Highway 111 WHEREAS, said application has complied with the require- ments of the "City of Palm Desert Environmental Quality Pro- cedure Resolution Number 74-14", in that the project is a minis- terial act and is therefore exempt from the requirements of the California Environmental Quality Act of 1970; and WHEREAS, at that time, upon receiving and considering the testimony and arguments, if any, of all persons who desired to be heard, said Commission did find the following facts and reasons to exist to approve the sign plan at a total of 50 sq. ft.: a) The design and location of the signs with a maximum of 50 sq. ft. on the front sign will be more compatible to neighboring developments and traffic, and will not unreasonably interfere with the use and enjoyment of neighboring developments and will not create traffic hazards or congestion. b) The design and location of the signs with a maximum of 50 sq. ft. on the front sign will be more in keeping with the character of the surrounding neighborhood and will not be detrimental to the harmonious, orderly, and attractive development contemplated by the Council in adoption of Ordinance No. 81 and the General Plan of the City. c) The design and location of the signs with a maximum of 50 sq. ft. on the front sign will be more aestheti- cally of good composition, materials, textures and colors. d) The limitation of 50 sq. ft. on the front sign will better ensure the protection of the public health, safety and general welfare in that it will have less of an adverse impact on vehicles travelling on Highway 111. -1- Planning Commission Resolution No. 105 e) The limitation of 50 sq. ft. on the front sign is in character with the scenic highway designation as applied in the City's General Plan and is implemented by the Scenic Preservation Overlay established in the recently adopted Zoning Ordinance which is being recommended to be adopted. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That it does hereby approve Plot Plan No. 14C, subject to the attached conditions. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Palm Desert, held on November 11, 1975 by the following vote: AYES: BERKEY, MULLINS, SEIDLER, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: ATTEST: (7) PAUL A.`WILLIAMS, Secretary -2- Nwe CONDITIONS OF APPROVAL 11/28/75 CASE NO. 14C (Liquor Store Signs) 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibit (s) X and Y), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City and other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project commencing within one year from approval date and being promptly completed. 4. No additional signs shall be permitted on the site except those expressly provided for in the Zoning Ordinance. 5. Signs shall not blink or flash. 6. Sign illumination shall be kept to a subdued level; lamps not greater than 30 watts in strength and soft white shall be used. 7. All existing illuminated signs shall be removed. 3. The area of the sign fronting on Highway 111 shall not exceed 50 sq. ft. 9. The Design of both signs must be approved by the Director of Environmental Services prior to any sign permit being issued.
