A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT,
CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A PLOT PLAN TO ALLOW
THE DEVELOPMENT OF A RESTAURANT PARKING LOT ON PROPERTY GENERALLY
LOCATED AT 74-225 STATE HIGHWAY 111. CASE NO. 24C.
WHEREAS, the Planning Commission of the City of Palm Desert did receive a
verified application from ROBERT DRIVER requesting approval of a Plot Plan on
property located in the C-P-S Zone and situated at 74-225 State Highway 111 to
allow for the development of a restaurant parking lot; the property being
more particularly described as:
Assessor's Parcel No. 625-112-006
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in
that the project is a ministerial act and not subject to the requirements of
the California Environmental Quality Act; and
WHEREAS, on December 16, 1975, the Planning Commission did consider this
request for Plot Plan Approval; and
WHEREAS, at that time, upon receiving and considering the testimony and
arguments, if any, of all persons who desired to be heard, said Commission did
find the following facts and reasons to exist to approve the Plot Plan:
(1) Conformance of the proposed project to the requirements of the
existing General Plan and Zoning Ordinance.
(2) The proposed development does ensure the protection of the public
health, safety and general welfare.
(3) Adverse impacts on adjacent residential property will be mitigated
by subsequent landscaping, lighting, and perimeter fencing plans.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows:
(1) That the above recitations are true and correct and constitute the
findings of the Commission in this case.
(2) That it does hereby approve Plot Plan No. 24C, subject to the attached
conditions.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission
of the City of Palm Desert, held on December 16, 1975 by the following vote:

CONDITIONS OF APPROVAL
CASE NO. 24C
1. The development of this project shall conform substantially to all development
plans submitted in behalf of this case (Exhibits A & B) and as revised according
to Planning Commission action. Any minor changes require approval by the
Director of Environmental Services. Any substantial change requires approval
by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City and
other applicable government entity shall be complied with as part of the
development process.
3. This approval is applicable, subject to the development of this project com-
mencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust or air conditioning equipment shall be fully concealed
from view from any public right-of-ways and adjoining properties by means of
screening as approved by the Director of Environmental Services.
5. Materials and colors shall match existing building design.
6. 10' sidewalk, curb cuts, and tie-in paving shall be provided along the full
frontage of the subject property on Highway 111 frontage road in conformance
with City Standard 'C'.
7. Landscaping (with irrigation system) shall be provided as approved by the DRB
for installation prior to final inspections.
8. A noncombustible trash storage area shall be provided for as approved by the DRB.
9. Storage and loading areas shall be provided and screened as approved by the DRB.
10. Lighting of parking areas and premises shall be provided as approved by the DRB.
11. Signage shall be provided in accordance with signage plan to be submitted to the
DRB and Planning Commission for final approval.
12. Traffic control provisions shall be provided as required by the Director of
Environmental Services.
13. Elevations are approved as shown.
14. Construction materials for walkways/pathways shall be provided as approved by
the DRB.
15. Detailed perimeter fencing plan and screening shall be submitted to the DRB for
approval prior to construction.
16. As a part of this approval, no mature trees shall be removed. Only relocation
of existing trees to other parts of the lot shall be permitted.
17. The parking lot shall be resurfaced with asphalt and striped in conformance to
the Zoning Ordinance.
18. The applicant shall remove the existing, free standing printing shop sign at
the corner of Highway 111 and El Paseo.
19. The applicant shall provide a grading plan to show how surface run-off water
from the south will be accepted onto the site and how the flow will be directed
through the parking lot.
20. A 4-foot wide planter, surrounded by 6" curb shall be installed between the
two columns of parking spaces east of the swimming pool.
21. Applicant shall agree in writing to all conditions contained herein within 30
days of the action by the Planning Commission.
