HomeMy WebLinkAboutRes No 114PLANNING COMMISSION RESOLUTION NO. 114 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A PLOT PLAN TO ALLOW THE DEVELOPMENT OF A 26-UNIT APARTMENT COMPLEX ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST INTER- SECTION OF SHADOW MOUNTAIN DRIVE AND CANDLEWOOD CASE NO. 27MF. WHEREAS, the Planning Commission of the City of Palm Desert did receive a verified application from AFFILIATED CONSTRUCTION CO. requesting approval of a Plot Plan on property located in the R-3 (3) Zone, and situated at the northeast corner of Shadow Mountain Drive and Candlewood to allow for the development of a 26-unit apartment project; the property being more particularly described as: Assessor's parcel nos: 625 - 171 - 001 625 - 132 - 034 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that the project is a ministerial decision and therefore not subject to the requirements of the California Environmental Quality Act of 1970, and; WHEREAS, on January 13, 1976, the Planning Commission did consider this request for Plot Plan Approval; and WHEREAS, at that time, upon receiving and considering the testimony and arguments, if any, of all persons who desired to be heard, said commission did find the following facts and reasons to exist to approve the Plot Plan: 1. The proposed development does conform to the Palm Desert General Plan and Zoning Ordinance. 2. The proposed development does ensure the protection of the public health, safety, and general welfare. 3. The proposed development is compatible with the existing and proposed development in the area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That is does hereby approve in concept Plot Plan No. 27MF, subject to the attached conditions: -1- Resolution No. 114 PASSES, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Palm Desert, held on January 13, 1976 by the following vote, to wit: AYES: BERKEY, MULLINS, VAN de MARK, WILSON, SEIDLER NOES: ABSENT: ABSTAIN: ATTEST: PAUL A. ILLIAMS, Secretary -2- illiam R Seidl,— 'airman CONDITIONS OF APPROVAL CASE NO. 27MF 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibits A, B, & C) and as revised according to DRB action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the DRB and Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project com- mencing within one year from approval date and being promptly completed. 4. All service lines for utilities shall be placed underground. 5. No roof top air conditioning equipment shall be permitted unless architec- turally obscured from sight from adjacent property and public rights -of -way. 6. Landscaping (with irrigation system) shall be provided as approved by the DRB for installation prior to final inspection and receiving certificate of occupancy. A 3-foot landscape berm shall be provided along Candlewood and Shadow Mountain Drive. 7. Perimeter screening in the form of fencing and landscaping shall be provided as approved by the DRB. A 36" masonry block wall shall be added adjacent to Candlewood and Shadow Mountain Drive; and a 5' wall adjacent to existing development on Candlewood. 8. 8" curb, gutter, curb cuts, and tie-in paving along the full frontage of the property on Candlewood and Shadow Mountain Drive shall be provided for by means of installation prior to final inspection. Construction shall conform to Riverside County Standards. 9. Noncombustible trash storage areas shall be provided for as shown. 10. Elevations are approved as shown. 11. Sewer hookup shall be made if mains exist within 200' of property. 12. A detailed grading plan showing how surface run-off water will be handled shall be submitted to the DRB for approval. 13. Detailed construction drawing and material & color samples shall be submitted to the DRB for approval. 14. Open parking area shall be revised as a single -aisle parking area. 15. The applicant shall offer for dedication, 25' strip on Lantana as a public right-of-way. 16. Applicant shall not remove any existing mature trees on the site, unless replaced by equivalent number of field -grown specimen trees. 17. Complete and detailed construction drawings, color samples, and materials shall be submitted to the Design Review Board and the Planning Commission for approval prior to construction. 18. The applicant shall deposit with the City of Palm Desert, prior to the issuance of a certificate of occupancy, a cash deposit equivalent to a pro rata share of the costs of undergrounding, for the entire block, those overhead utility distribution/transmission lines along the full frontage of the north and east boundary lines of the subject property. 19. Approval of this case is contingent upon the new zoning map becoming effective
