CASE NO. VARIANCE 01-76. WHEREAS, pursuant to the provisions of Section 25.39-5 of the Palm Desert Zoning Ordinance, the Planning Commission did on March 3, 1976, hold a duly noticed public hearing to consider the application of ROY W. CARVER for a variance to allow additional identification and directional signage on property in the C-1 (S.P.) Zone and situated on the south side of Palm Desert Drive between Lupine Lane and Sun Lodge Lane, more parti- cularly described as: APN 627-202-03 WHEREAS, the subject application is exempted or has been considered non -significant with regard to the requirements of the "Palm Desert En- vironmental Quality Procedure Resolution Number 74-14", and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find that the following facts and reasons to exist to justify the granting of said variance: 1. Special circumstances are applicable to the property or intended use that do not generally apply to other properties in the vicinity which are under identical zoning classification such as, adequate identification for some of the tenants does not exist from Highway 111. 2. The granting of such variance will not be materially detrimental to the public health, safety, welfare or injurious to the property or improve- ments in such vicinity and zone in which the property is located. 3. The granting of such variance will not adversely affect the General Plan as it conforms to the goals and policies set forth in the Core Area Plan. 4. The granting of the variance is necessary for the preservation and enjoyment of substantial property rights possessed by other property in the same vicinity and zones which would be denied to the property, if adequate identification were not allowed.
