HomeMy WebLinkAboutRes No 124PLANNING COMMISSION RESOLUTION NO. 124 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING THE FINDINGS AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW A COMMERCIAL PARKING LOT ON PROPERTY IN THE R-3 ZONING DISTRICT ON THE NORTH SIDE OF SHADOW MOUNTAIN DRIVE, WEST OF PORTOLA. CASE N0. CUP 03-76. WHEREAS, pursuant to the provisions of Section 25.12-3 of the Palm Desert Zoning Ordinance, the Planning Commission did on March 3, 1976, hold a duly noticed public hearing to consider the application of ALEX ROBERTSON for a Conditional Use Permit to allow a commercial parking lot on property located in the R-3(3) Zone and situated on the north side of Shadow Mountain Drive, west of Portola, and more particularly described as: Lot 10, Block V Palm Desert Unit No. 1 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Reso- lution Number 74-14", in that the Director of Environmental Services has determined that the project would not have a significant impact on the environment and the appeal period did expire; and, WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed project does conform to the existing zoning ordinance and the Palm Desert General Plan. 2. The proposed project is compatible to the existing and proposed development in the area. 3. The proposed project does insure the protection of the public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. Subject to confirmation by the City Council, the Con- ditional Use Permit is granted to ALEX ROBERTSON for reasons subject to the attached conditions. Resolution No. 124 PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on March 3, 1976, by the following vote, to wit: AYES: BERKEY, MULLINS, SEIDLER, WILSON NOES: NONE ABSENT: VAN DE MARK ABSTAIN: NONE ATTEST: \ \ \ PAUL A. WILLIAMS, Secretary Resolution No. 124 3/1/76 CONDITIONS OF APPROVAL CASE NO. CUP 03-76 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project commencing within one year from approval date and being promptly com- pleted. 4. All overhead utility distribution lines along the rear of the lot shall be removed. 5. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving along the full frontage of the property on Portola and Shadow Mountain Drive shall be provided in conformance with Riverside County Standards and as approved by the Design Review Board. 6. Lighting of parking areas if provided, shall be provided for as approved by the Design Review Board. 7. Traffic control provisions shall be provided as required by the Design Review Board. 8. Applicant agrees to join any assessment district formed that includes the subject property within its boundaries. 9. Applicant shall agree in writing to all conditions contained herein, within 30 days hereof or said approval shall be null and void. 10. The uses of the proposed building shall be limited to business and pro- fessional offices.
