HomeMy WebLinkAboutRes No 130`NLANNING COMMISSION RESOLUTION Vi 130 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTA- TIVE MAP TO ALLOW FOR DEVELOPMENT OF A 107-LOT, 100- UNIT CONDOMINIUM SUBDIVISION ON 20 ACRES OF LAND, GENERALLY LOCATED ON THE EAST SIDE OF PORTOLA, SOUTH OF 44th AVE. CASE NO. TRACT 6671. WHEREAS, the Planning Commission of the City of Palm Desert, did receive a verified application from Fred G. Rice Construction Co., requesting approval of a 107-lot, 100-unit subdivision on 20 acres of land, located in the PR-5(N) zone and situated on the east side of Portola, between El Cortez and Goleta Avenues, more particularly described as: a portion of the N 2 of the NW 4 Section 21, T5S, R6E, SBB & M WHEREAS, said application had complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Impact Report was submitted and certified as complete by the City Council, and; WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies, and; WHEREAS, the Planning Commission did find that the subject Tentative Map does substantially comply with the City of Palm Desert Code (County Ordinance Number 460), and the State of California Sub- division Map Act, as amended; WHEREAS, the Planning Commission did find that the subject Tentative Map does comply with the adopted General Plan, and; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1) that the above recitations are true and correct and constitute the findings of the commission in this case; 2) that it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 6671, subject to fulfillment of the following conditions as attached; PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning Commission held on the 30th of March, 1976, by the following vote, to wit: Resolution No. 130 AYES: BERKEY, KELLY, VAN DE MARK, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ILSO AIRMAN ATTEST: \\-\ PAUL A. WILLIAMS, SECRETARY New Resolution No. 130 3/24/76 CONDITIONS OF APPROVAL CASE NO. TT 6671 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force. 2. Prior to consideration of the final map and improvement plans, a com- plete drainage and grading plan of the tract shall be submitted to the Director of Environmental Services for approval. 3. The C. C. & R.'s for this development shall be submitted to the City Attorney for review and approval prior to the issuance of any build- ing permits. 4. If requested by the City Engineer, an amended tentative map shall be submitted for approval by the City Engineer prior to preparation of the final map to assure compliance to all conditions of approval. 5. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 6. Install a water system capable of delivering 2,500 GPM fire flow for a two hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 7. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travelways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 8. Prior to issuance of a building permit or recordation of final map the developer shall furnish the original and four copies of the water system plan to the Riverside County Department of Fire Protection for review. Upon approval, two copies will be sent to the Palm Desert Department of Building and Safety, Land Use Division, and the original will be returned to the developer. 9. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify the design of the water system in Tract Number 6671 is in accordance with the requirements prescribed by the Riverside County Department of Fire Protection". 10. All public improvements shall be made in conformity to standards adopted by the City of Palm Desert. 11. Improvement plans for water and sewer system shall meet the requirements of the respective service districts, 12. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view; including existing lines along Portola Avenue. 13. Complete plans and specifications shall be submitted as required for checking and approval, before construction of any improvements is com- menced. The subdivider shall submit the original drawings revised to reflect as -built conditions, prior to acceptance of the subdivision im- provements by the City. -1- Iolution No. 130 Conditions of Approval Case No. TT 6671 March 24, 1976 14. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert without cost to the City, and free of all liens and encumbrances. 15. Street names and numbers shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the City of Palm Desert on file in the Building Department. 16. The subdivider shall submit for approval a soils report for stability and geological study to the Riverside County Surveyor's Office, prior to recordation of the final map, unless waived by the Director of Environmental Services. 17. A management company with the unqualified right to assess the owners of the individual units for reasonable maintenance costs shall be es- tablished and continuously maintained. The management company shall have the right to lien the units of the owners who default in the pay- ment of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of trust provided such deed of trust is made in good faith and for value and is of record prior to the lien of the management company. 18. The subdivider shall offer for dedication the following: 1) 14' along the full length of Portola (Lot A) 2) 60' full width of Catalina Way (Lots B, C, D, E, & F) 3) 30' width along the easterly boundary (Lots G & H) 19. The subdivider shall make the following improvements: With Phase I: 1) Improvement of Portola south of the Catalina Way intersection including new 8 inch curb and gutter with 6 foot sidewalk, and all tie-in paving, to City Standards. 2) Full improvement of the intersection at Catalina Way and Portola for the full width of Catalina Way a depth of 180', and on Portola the first 100' north of the center of the intersection and to include handicap ramps. 3) Improvement of south 42' of Catalina Way to the east end of Phase I, inlcuding 6 inch curb and gutter with a 5' sidewalk. With Phase II: 1) Complete the remaining improvements on Portola Avenue, including 8 inch curb and gutter, 5 foot sidewalk, and all tie-in paving. 2) Complete the remaining improvements on Catalina Way that relate directly to Phase II. 20. Complete signage plan shall be approved by the Design Review Board and the Planning Commission to include but not limited to stop signs and street signs. -2.
