HomeMy WebLinkAboutRes No 131PLANNING COMMISSION RESOLUTION le131 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CON- DITIONAL USE PERMIT TO ALLOW AN ADDITION OF 19 SPACES TO THE SILVER SPUR MOBILE MANOR ON PROPERTY GENERALLY LOCATED WEST OF HIGHWAY 74 AND SOUTH OF THE INDIAN SPRINGS MOBILE PARK. CASE NO. CUP-04-76. WHEREAS, pursuant to the provisions of Section 18.26 of the Palm Desert Zoning Code, the Planning Commission did on March 30, 1976, hold a duly noticed public hearing to consider the application of C. Robert Hubbard for a Conditional Use Permit to allow for development of 19 mobile home spaces on property located in the R-M Zone and situated west of Highway 74 and south of the Indian Springs Mobile Park and more particularly described as: a portion of assessor's parcel no. 631-115-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that it is exempt as an on -going project initiated prior to the enactment of CEQA, and; WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the conditional use is in accord with the objectives of this Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this Ordinance. 4. The proposed conditional use complies with the goals, objectives, and policies of the City's General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. The Conditional Use Permit is granted to C. Robert Hubbard for SILVER SPUR MOBILE MANOR subject to the attached conditions: PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Commission held on March 30, 1976, by the following vote, to wit: Resol ion No. 131 AYES: NOES: ABSENT: ABSTAIN: BERKEY, KELLY, VAN DE MARK, WILSON NONE NONE NONE Y WIL,.8 N, Chairman ATTEST: PAUL A. WILLIAMS, Secretary • RESOLUTION NO. 131 CONDITIONS OF APPROVAL CUP 04-76 1. The development of the project shall conform with the Plot Plan marked Exhibit "A" on file with Conditional Use Permit No. 04-76 in the office of the Department of Environmental Services. 2. This permit shall be used within one year after the final proceedings before the Palm Desert Planning Commission, otherwise it shall become null and void and of no effect whatsoever. By "use" is meant the be- ginning of construction. 3. All interior streets, driveways, and parking areas shall be improved with 2-inch asphalt concrete paving (plant mix) over adequate base material. 4. Prior to occupancy of any particular space, the applicant shall construct a concrete slab or wooden deck on that space. 5. Prior to final inspection and occupancy detailed landscaping, irrigation, trash storage, off-street guest parking, and lighting plans shall be submitted to the Department of Environmental Services for approval. These improvements shall be made a part of construction and no Certificate of Occupancy shall be issued until they have been completed. 6. Prior to the issuance of a building and grading permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from: Coachella Valley County Water District Department of Public Health State Water Quality Control Board No. 7 Riverside County Department of Fire Protection Prior to the issuance of a building permit, the Applicant shall submit to the County Health Department information indicating that sewage and waste disposal are feasible in accordance with existing regulations of the State and County and that water is obtainable from an approved source. Written evidence of said permit or clearance shall be presented to the Department of Building and Safety at the time of the issuance of a building permit. 7. The applicant shall provide fire protection as outlined in the letter of March 19, 1976, from the Riverside County Department of Fire Protection, subject to a meeting between the Fire Agency, the Director of Environmental Services and the Applicant. 8. All existing and proposed overhead utility transmission/distribution lines adjacent or within the proposed development site shall be placed underground as a part of construction. 9. The applicant shall submit a written statement of acceptance to the Department of Environmental Services for the above -listed conditions of approval prior to the issuance of a building permit.
