HomeMy WebLinkAboutRes No 132PLANNING COMMISSION RESOLUTION NO. 132 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A VARIANCE TO ALLOW A DECREASE IN THE SIDE YARD SETBACK FROM 15' TO 7' & 12' ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF VERBA SANTA, SOUTH OF TUMBLEWEED. CASE NO. VARIANCE 02-76. WHEREAS, pursuant to the provisions of Section 25.39-5 of the Palm Desert Zoning Code, the Planning Commission did on March 30, 1976, hold a duly noticed public hearirg to consider the application of John Mandic from Section 25.10-7.04 for a variance to allow a reduction in the side yard setback from 15' on each side to 7' and 12' on property located in the R-1-20,000 Zone and situated on the east side of Verba Santa, between Tumbleweed and Ironwood, and more particularly described as: The south 75 feet of Lot 6 block G-3 of Palm Desert Unit 3. WHEREAS, the subject application is exempted or has been considered nonsignificant with regard to the requirements of the "Palm Desert Environmental Quality Procedure Resolution Number 74-14". WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find that the following facts and reasons to exist to justify the granting of said variance: 1. Special circumstances or conditions are applicable to the property or intended use that do not apply generally to other properties in the vicinity which are under identical zoning classification, SUCH AS: this lot is only 75' wide and has only 10,000 sq. ft. where other lots in the same zone have 20,000 sq. ft. 2. The granting of such variance will not be materially detrimental to the public health, safety, welfare or infurious to the property or improvements in such vicinity and zone in which the property is located, because other lots in the area have setbacks on the side of 5' as allowed by the property owners. 3. The granting of such variance will not adversely affect the General Plan. 4. The granting of this variance is necessary for the preservation and enjoyment of substantial property rights possessed by other property in the same vicinity and zones which would be denied to the property because ,solution No. 132 Nwo this property would have to develop to different standards than other lots in the same vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1) that the above recitations are true and correct and constitute the findings of the commission in this case; 2) that variance is granted for reasons. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on March 30, 1976, by the following vote, to wit: AYES: BERKEY, KELLY, VAN DE MARK, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ILSON !/Chairman ATTEST: PAUL A.
