HomeMy WebLinkAboutRes No 141Name ',woe PLANNING COMMISSION RESOLUTION NO. 141 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND ACCEPTING THE WITHDRAWAL OF AN APPLICATION FOR A CONDITIONAL USE PERMIT TO ALLOW A 100-UNIT HOUSING FACILITY FOR THE ELDERLY ON PROPERTY GENERALLY LO- CATED ON THE WEST SIDE OF HIGHWAY 74, NORTH OF HAY- STACK ROAD EXTENDED. CASE NO. CUP 01-76 WHEREAS, pursuant to the provisions of Section 25.22-3 of the Palm Desert Zoning Ordinance, the Planning Commission did on February 3, 1976, March 3, 1976, March 30, 1976, and May 4, 1976, hold four duly noticed public hearings to consider the application of LAMBETH HOUSE, INC., for a Conditional Use Permit to allow a 100-unit housing facility for the elderly on property located in the P Zone and situated on the west side of Highway 74, north of Haystack Road extended, and more particularly described as: APN 628-150-005 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that a Negative Declaration was filed and the appeal period has expired; and, WHEREAS, at said public hearings, upon hearing and considering all testimony and arguments, if any, the Planning Commission did find the following facts and reasons to exist to take no action on said Conditional Use Permit: 1. The applicant has withdrawn his request for the project approval. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. The withdrawal of application No. CUP 01-76 is accepted, PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Palm Desert held on May 4, 1976, by the following vote, to wit: -1- Resolution No. 141 AYES: KELLY, VAN DE MARK, WILSON NOES: ABSENT: ABSTAIN: NONE NONE BERKEY Y WILSOr, CHAIRMAN ATTEST: C 7\k \ \ \ PA(JL A.
