HomeMy WebLinkAboutRes No 150'sloe Nwe PLANNING COMMISSION RESOLUTION NO. 150 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING WITHOUT PREJUDICE A REQUEST FOR A CHANGE OF ZONE FROM R-1-10,000 to R-3-3,000, ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF CATALINA WAY BETWEEN SAN PABLO AND SAN PASCUAL. CASE NO. C/Z 01-76 WHEREAS, the Planning Commission did on the 1st day of June, 1976, hold a duly noticed Public Hearing to consider a Change of Zone application, filed by CATALINA GARDEN APARTMENTS, from R-1-10,000 to R-3-3,000, on property generally located on the north side of Catalina Way between San Pablo and San Pascual, and more particularly described as: Lot 14, Palma Village Greens WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Assessment form was submitted and a Negative Declaration determination was made and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the denial of the Change of Zone necessary to carry out the provisions and general purpose of the adopted City Zoning Ordinance: 1) The proposed zoning does not conform to the overall character of the area. 2) The area along Catalina Way is largely vacant and the granting of a Change of Zone would be precedent setting. 3) The Planning Commission recently reviewed this area in great detail and determined that Multiple Zoning would not be appropriate. 4) The property lies within the College of the Desert Specific Plan Area and any decision now on this parcel would be premature to the Specific Plan. Palm NOW, THEREFORE, BE IT RESOLVED by the Planning Commission Desert as follows: 1) That the above recitations are findings of the Commission in this case. 2) That the Planning Commission does hereby deny without prejudice the request for Change of Zone from R-1-10,000 to R-3-3,000 for reasons set forth in this resolution, and the denial is final unless appealed to the City Council. true an d of the City of correct and constitute the -1- RESOLUTION NO. 150 PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Palm Desert, held on the 1st day of June, 1976, by the following vote, to wit: AYES: Berkey, Kelly, Mills, Van de Mark, Wilson NOES: None ABSENT: None ABSTAIN: None ATTEST: PAUL A.
