A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND DENYING
A DEVELOPMENT PLAN FOR A 5-ACRE RESIDENTIAL SUBDIVISION
ON PROPERTY GENERALLY LOCATED EAST OF HIGHWAY 74 AND
SOUTH OF MESA VIEW DRIVE.
CASE NO. DEVELOPMENT PLAN 02-76
WHEREAS, the Planning Commission did on the 29th day of June, 1976, hold
a duly noticed Public Hearing to consider a Development Plan application,
filed by COVE CONSTRUCTION, for a 5-acre residential subdivision on property
generally located east of Highway 74 and south of Mesa View Drive, and more
particularly described as:
the north 1/2 of the northwest 1/4
of the southwest 1/4 of the north-
east 1/4 of Section 31, T.5S, R.6E,
S.B.B. & M.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in
that an Environmental Assessment form was submitted and a Negative Declaration
determination was made by the Department of Environmental Services on June 15,
1976, and the appeal period has expired; and,
WHEREAS, at said Public Hearing, upon hearing and considering the testimony
and arguments, if any, of all persons desiring to be heard, said Planning Com-
mission did find the following facts and reasons to exist to deny said develop-
ment plan:
1. The project is not compatible with existing and proposed develop-
ment in the area.
2. The project does not meet the intent and purpose of the "PR" Zoning
District as stated in the Palm Desert Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1) that the above recitations are true and correct and constitute the
findings of the Commission in this case;
2) that it does hereby deny the request for development plan approval
for reasons set forth in this resolution.

CONDITIONS OF APPROVAL
CASE NO. DP 02-76
I. STANDARD CONDITIONS:
1. The development of the property shall conform substantially with that
as shown on plot plan marked Exhibit "A" on file with the Department
of Environmental Services, Case No. DP 02-76, unless otherwise amended
by the following conditions.
2. Prior to issuance of a building permit, for any condominium structure,
a subdivision shall be recorded conforming substantially with said
Exhibit "A".
3. Prior to the issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following public agencies:
County Dept. of Public Health
County Road Department
Palm Desert Design Review Board
Dept. of Fire Protection (Indio)
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be
presented to the Building and Safety Division of the Department of
Environmental Services at the time of the issuance of a building permit
for the use contemplated herewith.
4. A landscaping, grading, lighting, amenities, wall design, and irrigation
plan shall be submitted through the Design Review Process. The building
permit when issued shall include the grading, lighting, amenities, walls,
and irrigation systems. No final inspection or occupancy shall be given
by the Department of Environmental Services to this project until the
aforementioned approved plans and construction shall have been completed.
5. The following Fire Protection Requirements shall apply:
The applicant shall conform to all requirements and improvements
deemed necessary by the Riverside County Department of Fire
Protection and Planning and the City of Palm Desert.
6. Construction of the development permitted hereby may be done progressively
in stages.
7. The sewage disposal system shall be submitted to and approved by the
Coachella Valley County Water District prior to issuance of a building
permit.
8. This approval shall be used within one (1) year after final proceedings
before the City Council, otherwise it shall become null and void and of
no effect whatsoever. By "use" is meant recordation of a subdivision
map and beginning of construction of a portion of the project.
9. Prior to the effective date of any City Council Ordinance approving this
Development Plan, the applicant shall agree in writing to any conditions
of approval.
II. SPECIAL CONDITIONS:
1. The applicant shall underground all overhead utility distribution lines
along the project boundaries from the nearest off -site existing poles
adjacent to the subject property boundary. No new poles shall be in-
stalled without the prior approval of the City.
2. A decorative masonry wall shall be installed along Mesa View Drive.
3. No dwelling shall be less than 1,500 square feet of living area and shall
include a covered patio area.

4. Mesa View Drive shall be connected to the existing street to the east.
5. Twelve (12) foot radius landscaped area shall be installed in the
center of each cul-de-sac.
6. A decorative masonry wall shall be required along the full frontage
of the west property line.
7. The C.C. & R's for the project shall contain provisions for the main-
tenance of landscaped areas along Mesa View Drive and within the center
of the cul-de-sacs.
8. The 5 lots at the corners shall have the housing unit flipped over to
get the drainage further away from the intersection.
9. The project shall not be sent to the City Council until the Design
Review Board Process has approved the unit design.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with
all the conditions set forth, and understand that the Department of Building
and Safety will not issue a building permit or allow occupancy on the use
permitted until this signed confirmation has been received by the Department
of Environmental Services.
