HomeMy WebLinkAboutRes No 162Now PLANNING COMMISSION RESOLUTION NO. 162 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING DESIGN REVIEW BOARD ACTIONS OF JUNE 22, 1976. WHEREAS, the Planning Commission of the City of Palm Desert did review the Design Review Board Actions of June 22, 1976, approving: Case No. 31MF - 22-Unit Apartment Complex for DWIGHT BABCOCK Case No. 37MF - 12-Unit Apartment Complex for GLEN VENTLING Case No. 33C - A 9,000 Square Foot Retail/Office Complex for JOHN HOOTEN WHEREAS, at that time, upon receiving and considering all testimony and arguments, if any, of all persons who desired to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board Actions of June 22, 1976. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the Design Review Board Actions of June 22, 1976; 3. That Case No. 31MF, Condition No. 5(b) is modified to read as follows: "The applicant shall comply with the intent of the undergrounding ordinance to the satisfaction of the City staff."; and that Case No. 33C, Conditions No. 12 and No. 13 are added to read as follows: "12. The applicant shall grant an easement on a portion of the property to the City for access and parking purposes in a form acceptable to the City Attorney." 13. The applicant shall agree in writing to join any assessment district formed that includes the subject property within its boundaries.". PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Com- mission of the City of Palm Desert, held on the 29th day of June, 1976, by the following vote, to wit: AYES: BERKEY, KELLY, MILLS, VAN DE MARK, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE . The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-C), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly com- pleted. 4. Any air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by means of screening as shown. 5. a) All service utility lines shall be placed underground. b) The applicant shall comply with the intent of the undergrounding ordinance to the satisfaction of,the City staff. 6. Curb, gutter, curb cuts, and tie-in paving shall be provided in con- formance with City Standards along the full frontage of the property on Panorama Drive. 7. Detailed construction plans, including landscaping, irrigation, signage, exterior lighting, grading, trash storage, and fencing plans, shall be submitted through the Design Review Process for approval prior to the issuance of a building permit. 8. The fence on the west property line shall be opaque in nature, utilizing wood, masonry, or chain link. 9. The applicant shall relocate air conditioning compressor units away from the bedroom windows. AGREEMENT I accept and agree, priot to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by means of screening as shown. 5. a) All service utility lines shall be placed underground. b) The applicant shall underground the overhead utility distribu- tion/transmission lines for the full length of the subject par- cel. 6. Curb, gutter, curb cuts, and tie-in paving shall be provided in confor- mance with City Standards along the full frontage of the property on Ocotillo and Highway 74 Frontage Road. 7. Detailed construction plans, including landscaping, irrigation, signage, exterior lighting, grading, trash storage, and fencing plans, shall be submitted through the Design Review Board Process for approval prior to the issuance of a building permit. 8. Revise building separations near carport. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-E), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly com- pleted. 4. Any air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by means of screening as shown. 5. All service utility lines shall be placed underground. 6. Sidewalks shall be provided in conformance with City Standards along the full frontage of the property on Palm Desert Drive. 7. Detailed construction plans, including landscaping, irrigation, signage, exterior lighting, grading, and trash storage shall be submitted through the Design Review Process for approval prior to the issuance of a building permit. 8. All existing signs on the building shall be removed. 9. Fascia area shall be recessed a minimum of twelve inches (12") on both roofs. 10. Lighter color of white for stucco shall be used. 11. Sample of balcony railing inserts shall be submitted to the Design Review Board for review. 12. The applicant shall grant an easement on a portion of the property to the City for access and parking purposes in a form acceptable to the City Attorney. 13. The applicant shall agree in writing to join any assessment district formed that includes the subject property within its boundaries. (Date) (Applicant's Signature) MINUTES PALM DESERT DESIGN REVIEW BOARD JUNE 22, 1976 I. The regularly scheduled meeting of the Palm Desert Design Review Board was called to order at 5:15 p.m. in the Council Chambers of the Palm Desert City Hall by Steve Fleshman. Members Present: Frank Urrutia (arrived at 5:30) Bernard Leung George Minturn Mike Buccino Jim Hill Members Absent: Bill Hobbs Paul Williams Staff Present: Steve Fleshman Sam Freed Also Present: Nelson Mills Carl Cox Al Cook John Outcault Laszlo Sandor The minutes of the meeting of May 25, 1976, were reviewed by the Board. Jim Hill indicated that he was present at the meeting and should not be shown as absent. Mr. Buccino moved and Mr. Minturn seconded that the minutes be approved as amended. Motion carried 4-0 (Buccino, Hill, Leung, Minturn). II. CASE NO. 31 MF - D. BABCOCK - Request for preliminary approval of 22 new apartment units located on the west side of Panorama Drive between Highway 111 and Abronia Trail (R-3). Carl Cox represented the applicant. Mr. Buccino was concerned with the air conditioner compressors being located too closely to bedroom windows. It was moved by Mr. Buccino and seconded by Mr. Minturn that the preliminary plans be approved subject to the revised con- ditions. Motion carried 4-0 (Buccino, Leung, Minturn, Urrutia). III. CASE NO. 33C - JOHN HOOTEN - Request for approval of preliminary plans for a remodel and addition to an existing building, located on the south side of Highway 111, west of Portola Avenue (C-1,S.P.). John Outcault, Architect, represented the applicant. Mr. Urrutia suggested that the fascia beam be recessed at least 12 inches. Mr. Buccino indicated that the stucco color looked grey and should have more white in it. The Board also requested a sample of the balcony railing insert material to be submitted for review with the con- struction plans. Mr. Buccino moved and Mr. Leung seconded that the plans be approved subject to the revisions requested by the Board. Motion carried 4-0 (Buccino, Leung, Minturn, Urrutia). IV. CASE NO. 37MF - GLENN VENTLING - Request for approval of preliminary plans for a 12-unit apartment complex on 2 lots fronting on Ocotillo and Highway 74 Frontage Road (R-3(3) S.P.). Laszlo Sandor represented the applicant. In reviewing the plans, Jim Hill pointed out that the minimum building separation was ten (10) feet, otherwise the structure would have to be attached. It was moved by Mr. Minturn and seconded by Mr. Buccino that the plans be approved subject to recommended conditions. Motion carried 4-0 (Buccino, Leung, Minturn, Urrutia). -1- MINUTES DESIGN REVIEW BOARD MEETING JUNE 22, 1976 V. CASE NO. 32C - L. H. GILLIGAN - Request for preliminary approval of a 9,500 square foot retail/office complex on the south side of Highway 111, east of Portola Avenue (C-1, S.P.). Al Cook represented the applicant. The staff explained its concerns with the submitted plans. The building frontage should be off -set instead of uniform and the parking layout should be revised. It was moved by Mr. Buccino and seconded by Mr. Min - turn that the case be continued so that the plans could be revised ac- cording to the staff's suggestions. Motion carried 4-0 (Buccino, Leung, Minturn, Urrutia). VI. FENCE STANDARDS for the CITY of PALM DESERT The staff presented several sketches of fences which represented minimum design standards. Mr. Urrutia felt that because of price and maintenance considerations, chain link was all that some people could afford and that as long as it was screened with landscaped hedges, it would be acceptable. Mr. Buccino felt that wood fences should be treated with a preservative. Wood fences should not be painted, but stained with transparent or opaque stain. Only redwood or cedar should be used because they don't deteriorate in weather. All fences should be stepped down slopes rather than angled.
