HomeMy WebLinkAboutRes No 163PLANNING COMMISSION RESOLUTION NO. 163 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTA- TIVE MAP TO ALLOW FOR DEVELOPMENT OF A 130-UNIT PLANNED RESIDENTIAL SUBDIVISION ON 37 ACRES OF LAND, GENERALLY LOCATED ON THE EAST SIDE OF MARIPOSA DRIVE, BETWEEN IRON - TREE DRIVE AND PORTOLA AVENUE. CASE NO. TRACT 5796 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from SILVER SPUR ASSOCIATES, requesting approval of a 130-unit planned residential subdivision on 37 acres of land located in the PR-7 zone and situated on the east side of Mariposa Drive, between Irontree Drive and Portola Avenue, more particularly described as: a portion of the east z of Section 32 T5S, R6E, SBB&M WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Impact Report was previously submitted for Conditional Use Permit 1382; further a Negative Declaration was made on this portion of the project by the Director of Environmental Services and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Ten- tative Map as submitted and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does substantially comply with the City of Palm Desert Municipal Code and the State of California Subdivision Map Act, as amended; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does comply with the adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1) that the above recitations are true and correct and constitute the findings of the Commission in this case; 2) that it does hereby recommend approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 5796, subject to the fulfillment of the attached conditions. -1- Niue Resolution No. 163 PASSED, APPROVED, and ADOPTED at a continued meeting of the Palm Desert Planning Commission held on the 27th day of July, 1976, by the fol- lowing vote, to wit: AYES: KELLY, VAN DE MARK, BERKEY NOES: NONE ABSENT: MILLS, WILSON ABSTAIN: NONE ATTEST: UL A. WILLIAMS, SECRETARY GEORGE BERKEY, VICE-CHAIRMAN • -2- Resolution No. 163 7/ 27/ 76 CONDITIONS OF APPROVAL CASE NO. TT 5796 1. Tract shall be processed in accordance with Ordinance 125, "Sub- division Ordinance". 2. The design of all private streets shall be subject to review and ap- proval by the City Engineer. Construction of all streets shall be inspected by the Engineering Department and a standard inspection fee shall be paid. 3. Developer shall enter into a future improvement agreement with the City to install a P.C.C. pedestrian way along the southerly side of Portola from Mariposa Drive to Buckboard Trail, at such time as the City deems necessary. Alignment shall be subject to approval of the City. 4. All drainage shall be handled in a manner satisfactory to the City Engineer. 5. The developer shall submit a street maintenance program satisfactory to the City Engineer prior to recordation of the final map. 6. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addi- tion to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 7. Prior to approval of the final map and improvement plans, a grading plan of the tract shall be submitted to the City Engineer for ap- proval. 8. The C.C. & R's for this development shall be submitted to the City Attorney for review and approval prior to the issuance of any building permits. 9. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 10. Install a water system capable of delivering 2,000 GPM fire flow for a two hour duration in addition to domestic or other supply. The compu- tation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 11. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travelways. A. The location of all hydrants shall be approved by the City Fire Marshall. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. 12. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify the design of the water system in Tract No. 5796 is in ac- cordance with the requirements prescribed by the Riverside County De- partment of Fire protection". -1- Swe Resolution No. 163 7/27/76 Conditions of Approval Case No. TT 5796 13. All public improvements shall be made in conformity to standards adopted by the City of Palm Desert. 14. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 15. All on -site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view. 16. Complete plans and specifications shall be submitted as required for checking and approval, before construction of any improvements is com- menced. The subdivider shall submit the original drawings revised to reflect as -built conditions, prior to acceptance of the subdivision im- provements by the City or Special District. This shall include plans for the interior streets. 17. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, or any other appropriate agen- cy, without cost to the City and free of all liens and encumbrances. 18. Street names and numbers shall be subject to approval and shall be des- ignated in accordance with the standards and policies adopted by the City of Palm Desert. 19. A homeowners association with the unqualified right to assess the owners of the individual units for reasonable maintenance costs shall be established and continuously maintained. The homeowners association shall have the right to lien the units of the owners who default in the payment of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of trust provided such deed of trust is made in good faith and for value and is of record prior to the lien of the homeowners association. 20. Curb and gutter shall be installed on all streets within the develop- ment to the specifications of the City Engineer. 21. The subdivider shall enter into a future improvement agreement to par- ticipate in the signalization of the Mariposa Drive and Portola Avenue "T" intersection on the basis of up to one-third participation in the cost of the installation of the signal at such time as traffic signal warrants are met. 22. The applicant shall include a statement in the Department of Real Estate disclosure document and in the C.C. & R's to the effect that: (1) the streets are private, (2) they are not maintained by the public, and (3) that if they should ever be offered to the City as public streets they would have to be in a condition suitable to the City. 23. Area shall be annexed to the Coachella Valley Stormwater Unit of the Coachella Valley County Water District, is so directed by the City Council.
