HomeMy WebLinkAboutRes No 167PLANNING COMMISSION RESOLUTION NO. 167 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS RELATIVE TO A CLARIFICATION OF THE PALM DESERT ZONING ORDINANCE CONCERNING THE OPERATION OF RESTAURANTS IN THE MULTI -FAMILY RESIDENTIAL (R-3) ZONE. CASE NO. ZOC-05-76. WHEREAS, the Planning Commission of the City of Palm Desert did receive a written statement from GEORGE RITTER requesting a clarification by said Commission on appropriate provisions of the Palm Desert Zoning Ordinance relating to the location of a restaurant in association with a hotel in the Multi -Family Residential Zone; and, WHEREAS, on August 17, 1976, the Planning Commission of the City of Palm Desert did consider this request for clarification, along with testimony and arguments, if any, of all persons who de- sired to be heard; and, WHEREAS, the Commission did find the following to justify its decision: 1. The zone already permits limited commercial uses directly related to private recreational facilities such as country clubs, tennis and swim clubs, and golf courses. 2. Requiring a CUP will permit the mitigation and care- ful regulation of any such activities. 3. By requiring restaurants in association with hotel facilities, the emphasis of design can still be focused on the residential element. 4. A restaurant -hotel combination provides for a bene- ficial relationship that allows tourists to walk to a restaurant instead of being forced to drive. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. -1- RESOLUTION NO. 167 2. That a restaurant facility shall be a conditional use in the Multi -Family Residential District (R-3), provided that said use is operated in conjunction with and incidental to a hotel facility. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Palm Desert Planning Commission held on the l7th day of August, 1976, by the following vote to wit: AYES: NOES: ABSENT: ABSTAIN: ATTEST: BERKEY, KELLY, VAN DE MARK, WILSON NONE MILLS NONE PAUL A.
