HomeMy WebLinkAboutRes No 168PLANNING COMMISSION RESOLUTION NO. 168 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING AN ADJUSTMENT TO ALLOW A TWO -FOOT FENCE AROUND A THERAPY POOL ON PROPERTY LOCATED AT 73-465 IRONWOOD STREET. CASE NO. ADJ-08-76. WHEREAS, pursuant to the provisions of Section 1.2 (e) of Ordinance No. 123 of the City of Palm Desert, the Planning Commission did on August 17, 1976, hold a hearing to consider the application of MR. CHARLES JACOBS for an adjustment to allow a two -foot fence around a therapy pool on property located in the R-2-8000 (4), S.P. Zone and situated at 73-465 Ironwood Street and more particularly described as: Lot 2, Tract 2412 WHEREAS, the subject application is exempted with regard to the requirements of tine"Palm Desert Environmental Quality Procedure Resolution Number 74-14;" and, WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find the following facts and reasons to exist to justify said adjustment: 1. The existing fence is identical with all other fences of adjacent lots in this area. 2. The therapy pool has a raised wall and does not present the same hazard as a swimming pool which is level with the grade immediately adjacent to it. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1) that the above recitations are true and correct and constitute the findings of the commission in this case; 2) that the requested adjustment is approved for Case No. ADJ-08-76. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on August 17, 1976, by the following vote, to wit: AYES: Berkey, Van de Mark, Wilson NOES: Kelly ABSENT: Mills ABSTAIN: None RESOLUTION NO. 168 LSON, CHA MAN ATTEST: PAUL A.
