A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND
APPROVING DESIGN REVIEW BOARD ACTIONS OF AUGUST 10,
1976.
WHEREAS, the Planning Commission of the City of Palm
Desert, did review the Design Review Board actions of August 10,
1976, approving:
Case No. 10SA - Building identification sign for RMW of
the DESERT, INC.
Case No. 39MF - 30-unit condominium project for FRED RICE
Case No. 34C - Commercial building addition for J. REID
Case No. 32C - Commerical building for L. H. GILLIGAN
Case No. 33C - Commercial building for J. HOOTEN
Case No. 42MF - Sales office and model complex at Ironwood
Country Club for SILVER SPUR ASSOCIATES
Case No. 45MF - 28-unit apartment complex for BRANKO LEPAN
WHEREAS, at this time, upon receiving and considering all
testimony and arguments, if any, of all persons who desired to
be heard, said Commission did find' sufficient facts and reasons
to exist to approve the Design Review Board actions of August 10,
1976.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the Commission in this case;
2. That it does hereby approve the Design Review Board
actions of August 10, 1976;
3. That Case No. 45MF, Condition No. 13 is modified to read:
"A six-foot wide concrete sidewalk built to City standards shall
be constructed along the full frontage of the subject property
on Highway 74 frontage road, Ocotillo Drive, and Verba Santa
Drive."
4. That Case No. 42MF, Condition No. 5 is amended to "Roof
top air-conditioning equipment shall be permitted when architec-
turally screened and integrated with the building; that Case
No. 42MF, Condition No. 7 is deleted.
5. That Case No. 39MF, Condition No. 7 is amended to
"Perimeter screening in the form of fencing and landscaping
shall be provided as required by CUP-03-75. Landscape hedges
shall be provided adjacent to chain -link fences;" and the Case
No. 39MF, Condition No. 12 is amended to "The date palm character
shall be particularly emphasized around the perimeter of the
project. Trees other than date palms or grapefruit trees shall
be used within the cul-de-sac drives, except for the two (2) cul-
de-sacs immediately east of Portola Avenue. The revised land-
scape plan (showing new tree species and plant sizes) shall be
submitted to the Department of Environmental Services for approval
prior to issuance of building permits.
PASSED, APPROVED, and ADOPTED at a regular meeting of the
Planning Commission of the City of Palm Desert, held on the
l7th day of August, 1976, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. 10SA - BUILDING IDENTIFICATION SIGN
1. The development of this project shall conform substantially
to all development plans submitted in behalf of this case
(Exhibit K), and as revised according to Design Review Board
action. Any minor changes require approval by the Director
of Environmental Services. Any substantial change requires
approval by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
3. This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
4. The maximum intensity of the sign shall be ten (10) candle-
power at ten (10) feet. There shall be no flashing or
blinking.
5. This approval shall only provide for one (1) sign on the
South Palm Desert Drive Frontage.
6. The sign shall be located one space down so that there will
be an open element in the wall above it.
AGREEMENT
I accept and agree, prior to the use of this permit or approval,
to comply with all the conditions set forth, and I understand
that the Department of Building and Safety will not issue a
permit or allow occupancy on the use permitted until this signed
confirmation has been recieved by the Department of Environmental
Services.

CONDITIONS OF APPROVAL
Case No. 39MF
1. The development of this project shall conform substantially
to all development plans submitted in behalf of this case
(Exhibit A), and as revised according to Design Review
Board action. Any minor changes require approval by the
Director of Environmental Services. Any substantial change
requires approval by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
3. This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
4. All service and distribution lines for utilities shall be
placed underground.
5. No roof top air conditioning equipment shall be permitted.
6. Landscaping plans, with irrigation system, shall be installed
as shown, as a part of construction.
7. Perimeter screening in the form of fencing and landscaping
shall be provided as required by Case No. CUP-03-75. Land-
scape hedges shall be provided adjacent to chain -link fences.
8. Curb, gutter, curb cuts, and tie-in paving shall be provided
for by means of installation. Construction shall conform to
City standards.
9. Elevations are approved as shown.
10. Sewer hookup shall be made.
11. The applicant shall comply with all fire flow requirements
specified in Case No. Tract 6671, or as otherwise established
by the Palm Desert Fire Marshall.
12. The date palm character shall be particularly emphasized
around the perimeter of the project. Trees other than date
palms or grapefruit trees shall be used within the cul-de-sac
drives, except for the two cul-de-sacs immediately east of
Portola Avenue. The revised landscape plan (showing new
tree species and plant sizes) shall be submitted to the
Department of Environmental Services for approval prior to
issuance of building permits.

CONDITIONS OF APPROVAL
CASE NO. 34C
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibit A), and
as revised according to Design Review Board action. Any minor changes
require approval by the Director of Environmental Services. Any sub-
stantial change requires approval by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this project,
commencing within one year from approval date and being promptly com-
pleted.
4. All service lines for utilities shall be placed underground.
5. No roof top air conditioning equipment shall be permitted.
6. Elevations are approved as shown.
7. Sewer hookup shall be made if mains exist within 200 feet of property.
8. The property owner shall provide the City of Palm Desert a public ac-
cess easement, subject to the approval of the City Attorney, covering
the parking area of the subject property prior to final inspection.
AGREEMENT
I accept and agree, prior to the use of this permit or approval, to comply with
all the conditions set forth, and understand that the Department of Building
and Safety will not issue a permit or allow occupancy on the use permitted un-
til this signed confirmation has been received by the Department of Environ-
mental Services.

CONDITIONS OF APPROVAL
CASE NO. 32C
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibits A-1,
B-1, and C), and as revised according to Planning Commission action.
Any minor changes require approval by the Director of Environmental
Services. Any substantial change requires approval by the Planning
Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this pro-
ject, commencing within one year from approval date and being promptly
completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully
concealed from view from any public rights -of -way and adjoining proper-
ties by architecturally integrated means.
5. All overhead utility distribution lines and new service lines shall be
placed underground. The Director of Environmental Services shall require
undergrounding as a part of construction.
6. Curb, gutter, sidewalk, and approved curb cuts shall be provided in con-
formance with Riverside County Standards and with approval from the City
Engineer, as a part of construction.
7. Signage shall be provided in accordance with signage plan to be submitted
to the Design Review Board Process for final approval.
8. Traffic control provisions shall be provided as required by the Director
of Environmental Services.
9. Elevations are approved as shown.
10. Final construction plans (including grading, landscaping, irrigation,
trash storage, and parking lot lighting plans) shall be submitted to
the Design Review Board Process for approval.
11. The applicant shall secure an access easement from the property owners
of both lots east and west of the subject site. Proof of such easements
shall be provided to the Director of Environmental Services prior to the
issuance of any building permits.
13. The applicant shall submit the final construction drawings to the City
Fire Marshall for approval prior to the issuance of a building permit.
14. The seven parking spaces shown as future on the plot plan labeled
Exhibit A-1 shall be installed as a part of construction.
15. No structural columns shall be placed in the 5-foot front yard setback.
A maximum overhang of three (3) feet shall be permitted into this area.
16. Street trees shall be located on private property or entirely deleted at
the discretion of the applicant.
AGREEMENT

with all the conditions set forth, and understand that the Department of
Building and Safety will not issue a permit or allow occupancy on the use
permitted until this signed confirmation has been received by the Department
of Environmental Services.

CONDITIONS OF APPROVAL
CASE NO. 33C
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibits A-E),
and as revised according to Planning Commission action. Any minor
changes require approval by the Director of Environmental Services.
Any substantial change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this pro-
ject, commencing within one year from approval date and being promptly
completed.
4. Any air conditioning equipment shall be fully concealed from view from
any public rights -of -way and adjoining properties by means of screening
as shown.
5. All service utility lines shall be placed underground.
6. Sidewalks shall be provided in conformance with City Standards along
the full frontage of the property on Palm Desert Drive.
7. Detailed construction plans, including landscaping, irrigation, signage,
exterior lighting, grading, and trash storage shall be submitted through
the Design Review Process for approval prior to the issuance of a building
permit. Street trees shall be located on private property and may be de-
leted entirely at the option of the applicant.
8. All existing signs on the building shall be removed.
9. Fascia area shall be recessed a minimum of twelve (12) inches on both
roofs.
10. Lighter color of white for stucco shall be used.
11. Sample of balcony railing inserts shall be submitted to the Design Review
Board for review.
12. The applicant shall grant an easement on a portion of the property to the
City for access and parking purposes in a form acceptable to the City At-
torney.
13. The applicant shall agree in writing to join any assessment district
formed that includes the subject property within its boundaries.

CASE NO. 42MF
Sales Office and Model Complex
1. The development of this project shall conform substantially
to the requirements of Case No. TUP 04-76 and to all develop-
ment plans submitted in behalf of this case (Exhibits A-P),
and as revised according to Design Review Board and Planning
Commission action. Any minor change requires approval by
the Director of Environmental Services. Any substantial change
requires approval by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with as part of the development process.
3. This approval is applicable, subject to the development of
this project, commencing within one year from approval date and
being promptly completed.
4. All service lines for utilities shall be placed underground.
5. Roof top air conditioning equipment shall be permitted only
if screened by means architecturally integrated with the
building.
6. Final construction plans, including landscaping, irrigation
trash storage, exterior lighting, and signage plans, shall
be submitted to the Design Review Board Process for approval.
7. Elevations are approved as shown.
8. Sewer hookup for the sales building shall be made if mains
exist within 200 feet of the property.
9. Proposed flag poles shall be deleted.
10. Required sign plans shall also include all proposed directional
signs.
AGREEMENT

the Department of Building and Safety will not issue a permit or
allow occupancy on the use permitted until this signed confirmation
has been received by the Department of Environmental Services.

CONDITIONS OF APPROVAL
CASE NO. 45MF
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibits A-K),
and as revised according to Design Review Board and Planning Com-
mission action. Any minor changes require approval by the Director
of Environmental Services. Any substantial change requires approval
by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this project,
commencing within one year from approval date and being promptly completed.
4. All service lines for utilities shall be placed underground. All over-
head distribution lines shall be placed underground as a part of construc-
tion.
5. No roof top air conditioning equipment shall be permitted.
6. Detailed final construction plans, including landscaping, irrigation,
fencing, trash storage, and exterior lighting plans, shall be submitted
to the Design Review Board Process prior to the issuance of building
permits.
7. Curb, gutter, curb cuts, and tie-in paving shall be installed prior to
final inspection on the full frontage of the property on Verba Santa
Drive, Ocotillo Drive, and on the east and west side of the Highway 74
Frontage Road. Said construction shall conform to Riverside County Stan-
dards and City of Palm Desert Standards and shall be approved by the City
Engineer prior to construction.
8. Elevations are approved as shown.
9. Sewer hookup shall be made if mains exist within 200 feet of property.
10. Garage dimensions shall be increased to 20' x 20' within the interior walls.
11. Preliminary landscape plan labeled Exhibits I and J are not approved.
Revised landscape plan and detailed irrigation plans shall be re -submitted
as a part of construction drawings refelcting the approved design of the
development.
12. Construction drawings shall include the provision for a decorative wall
along the Highway 74 Frontage of the property as approved by the Design
Review Board and Planning Commission.
13. A six (6) foot wide sidewalk shall be constructed along the full frontage
of the property on Highway 74 Frontage Road , Ocotillo Drive and
Verba Santa Drive.

all the conditions set forth, and understand that the Department of Building
and Safety will not issue a permit or allow occupancy on the use permitted until
