HomeMy WebLinkAboutRes No 172PLANNING COMMISSION RESOLUTION NO. 172 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW A TELEVISION BROADCASTING STATION AND OFFICE ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF PARK VIEW DRIVE AND WEST OF MONTEREY AVENUE. CASE NO. CUP 08-76 WHEREAS, pursuant to the provisions of Section 25.39 of the Palm Desert Zoning Code, the Planning Commission did on August 31, 1976, hold a duly noticed Public Hearing to consider the application of DESERT EMPIRE TELEVISION CORPORATION for a Conditional Use Permit to allow for the construc- tion of a Television Broadcasting Station and Office on property located in the PR-7, S.P. Zone and situated on the north side of Park View Drive, west of Monterey Avenue, and more particularly described as: APN 621-290-014 APN 621-290-017 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", as the Director of Environmental Services has determined that the project would not have a significant impact on the environment and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, the Planning Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1) that the proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the Zone District in which the site is located; 2) that the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare or be materially injurious to properties or improvements in the vicinity; 3) that the proposed conditional use does comply with each of the applicable provisions of the Zoning Ordinance. 4) that the proposed conditional use complies with the goals, objectives, and policies of the City's adopted General Plan. Resolution No. 172 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. The Conditional Use Permit is granted to DESERT EMPIRE TELEVISION CORPORATION subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on the 31st day of August, 1976, by the following vote: AYES: BERKEY, KELLY, MILLS, VAN DE MARK NOES: NONE ABSENT: NONE ABSTAIN: WILSON TTEST: PAUL A. WILLIAMS, SECRETARY -2- PLANNING COMMISSION RESOLUTION NO. 172 AUGUST 31, 1976 CONDITIONS OF APPROVAL CASE N0. CUP 08-76 1. The development of the property shall conform substantially with that as shown on Plot Plan marked Exhibits A & B on file with the Department of Environmental Services, Case No. CUP 08-76, unless otherwise amended by the following conditions. 2. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and clearance from the following public agencies: Department of Public Health Road Department Palm Desert Design Review Board Palm Desert City Fire Marshall Coachella Valley County Water District Regional Water Quality Control Board No. 7 Evidence of said permit or clearance from the above agencies shall be presented to the Building and Safety Division of the Department of Environ- mental Services at the time of the issuance of a building permit for the use contemplated herewith. 3. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Board Process for approval. The building permit when issued shall include the grading, lighting, amenities, trash storage, walkways, and irrigation systems. No final inspection or occupancy shall be given by the Department of Environ- mental Services to this project until the aforementioned approved plans and construction shall have been completed. 4. The sewage disposal system shall be submitted to and approved by the Coachella Valley County Water District prior to issuance of a building permit. 5. This approval shall be used within one year, otherwise it shall become null and void. 6. Curb, gutter, and tie-in paving along Park View Drive shall be installed to City Standards, with curb face at 32 feet from centerline of 44 foot half - width right-of-way. 7. Utility service lines shall be placed underground. 8. A five (5) to six (6) foot decorative masonry wall shall be installed along the northerly 320 feet of the westerly property line. All other fencing shall be approved by the Design Review Board Process. 9. The landscaping plan shall include treatment of the equestrian trail along the northerly property line. 10. Provide a water system capable of delivering 3,000 GPM fire flow for a three (3) hour duration in addition to domestic or other supply. The com- putation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 11. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet away from a fire hydrant measured along approved vehicular travelways. a. Hydrants shall not be located closer than 25 feet to any building. b. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. c. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. -1- Conditions of Approval CUP 08-76 August 31, 1976 Planning Commission Resolution No. 172 12. Prior to issuance of a building permit, the developer shall furnish the original and four copies of the water system plan to the River- side County Department of Fire Protection for review. Upon approval, two copies will be sent to the City of Palm Desert, Department of Building and Safety, and the original will be returned to the developer. 13. The building plans shall be reviewed by the City Fire Marshall to de- termine whether it should be protected by a completely automatic sprink- ler system in accordance with National Fire Protection Association Stan- dard No. 13. 14. The building plans shall be reviewed by the City Fire Marshall to determine whether the requirements of Title 19 of the California Administrative Code apply to the project. 15. Area shall be annexed to Improvement Districts No. 54 and 80 of the Coachella Valley County Water District for sanitation service. 16. The property owner shall agree to participate in any storm drainage district that may be formed which encompasses the subject property. 17. The existing lot line between the two properties shall be deleted. 18. The applicant shall provide a future agreement in a form acceptable to the City Attorney for the installation of an 8 foot wide concrete bike- way/pedestrianway, 4 feet north of the curb line along the full frontage of the property on Park View Drive including a handicapped curb ramp at the intersection of the right-of-way with the west property line at a time as determined by the City.
