A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING
A PLOT PLAN TO ALLOW THE DEVELOPMENT OF OFFICES AND TELEVISION
STUDIOS FOR KMIR-TV ON PROPERTY GENERALLY LOCATED NORTH OF
PARK VIEW DRIVE AND WESTERLY OF MONTEREY AVENUE.
CASE NO. 44MF
WHEREAS, the Planning Commission of the City of Palm Desert did receive
a verified application from DESERT EMPIRE TELEVISION requesting preliminary
approval of Plot Plan No. 44MF, labeled Exhibits A, B, and C, on property
located in the PR-7 Zone, and situated on the north side of Park View Drive,
westerly of Monterey Avenue to allow for the development of television studios
and offices for KMIR-TV; the property being more particularly described as:

WHEREAS, said application is exempt from the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in
that Design Review Board process approval is a ministerial act, and;
WHEREAS, on August 31, 1976, the Planning Commission did consider this
request for the Plot Plan Approval; and
WHEREAS, at that time, upon receiving and considering the testimony and
arguments, if any, of all persons who desired to be heard, said commission did
find the following facts and reasons to exist to approve the Plot Plan:
1. That the proposed development conforms to all legally adopted
development standards.
2. That the design and location of the proposed development and its
relationship to neighboring, existing, or proposed developments and traffic is
such that it will not impair the desirability of investment or occupation in
the neighborhood; and that it will not unreasonably interfere with the use and
enjoyment of neighboring, existing, or proposed development, and that it will
not create traffic hazards or congestion.
3. That the design and location of the proposed development is in keeping
with the character of the surrounding neighborhood and is not detrimental to the
harmonious, orderly, and attractive development contemplated by the Zoning
Ordinance and General Plan of the City.
4. That the design and location of the proposed development would provide a
desirable environment for its occupants, as well as for its neighbors and that
it is aesthetically of good composition, materials, textures, and colors.

5. The proposed use does conform to all the requirements of the zone in
which it is located and all other applicable requirements.
6. The overall development of the land is designed to ensure the pro-
tection of the public health, safety, and general welfare
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That it does hereby approve Plot Plan No. 44MF, subject to the
attached conditions.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission
of the City of Palm Desert, held on 31st day of August, 1976, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. 44MF
1. The development of this project shall conform to all conditions of Case
No. CUP 08-76 and to all development plans submitted in behalf of this
case (Exhibits A-C), and as revised according to Planning Commission ac-
tion. Any minor changes require approval by the Director of Environmental
Services. Any substantial change requires approval by the Planning Com-
mission.
2. All requirements of any law, ordinance, or regulation of the State, City,
and any other applicable government entity shall be complied with as part
of the development process.
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights -of -way and adjoining properties by
architecturally integrated means.
5. All utility distribution lines that traverse or are adjacent to the subject
property shall be placed underground as a part of construction. All utility
service lines shall be underground.
6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving
shall be provided along the full frontage of the property on Parkview Drive
within a half -width row of fourty-four (44) feet, in conformance with River-
side County Standards and approval of the City Engineer.
7. Signage shall be provided in accordance with signage plan to be
the Design Review Board Process for final approval.
8. Traffic control provisions shall be provided as required by the
Environmental Services.

10. Final construction drawings, including grading, landscaping, irrigation, trash
storage, storage and loading, fencing and screening, and parking lot lighting
plans shall be submitted to the Design Review Board Process for approval.
11. Construction drawings shall include specific plans depicting the method of
screening of all roof -top equipment.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all the
conditions set forth, and understand that the Department of Building and Safety will
not issue a permit or allow occupancy o the use permitted until this signed confir-
mation has been received by the Departs Ot of Environmental Services.
