HomeMy WebLinkAboutRes No 177PLANNING COMMISSION RESOLUTION NO. 177 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING DESIGN REVIEW BOARD ACTIONS OF AUGUST 24, 1976. WHEREAS, the Planning Commission of the City of Palm Desert, did review the Design Review Board actions of August 24, 1976, approving: Case No. 36C - Minor Commercial Addition for J. CABANYOG Case No. 37MF - 12-Unit Apartment Complex for GLENN VENTLING Case No. 46MF - 36-Unit Condominium Project at Ironwood Country Club for SILVER SPUR ASSOCIATES WHEREAS, at this time, upon receiving and considering all testimony and arguments, if any, of all persons who desired to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of August 24, 1976. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the Design Review Board actions of August 24, 1976. PASSED, APPROVED, and ADOPTED at a regular meeting of the Planning Commission of the City of Palm Desert, held on the 31st day of August, 1976, by the following vote, to wit: AYES: BERKEY, KELLY, MILLS, VAN DE MARK, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: PAUL A. WILLIAMS, SECRETARY (Commercial) August 24, 1976 CONDITIONS OF APPROVAL CASE NO. 36C 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibit A), and as revised ac- cording to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service utility lines shall be placed underground. 5. A six foot (6') concrete sidewalk to match the existing lot to the west shall be provided in conformance with Riverside County Standards. 6. Landscaping (with irrigation system) shall be provided as shown. 7. A non-combustible trash storage area shall be provided in conformance to the requirements of City Ordinance No. 88. 8. Storage areas shall be screened from view by a wood fence or landscape hedge along the Highway 111 frontage. 9. Lighting of parking areas and premises shall be provided as approved by the Director of Environmental Services. 10. Signage shall be provided as modified. 11. The parking area shall be constructed to City Standards and shall be kept free and clear at all times. The gates to the parking area shall be kept open during working hours. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, com- mencing within one year from approval date and being promptly completed. 4. Any air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by means of screening as shown. 5. All service utility lines shall be placed underground. The applicant shall underground the overhead utility distribution/transmission lines for the full length of the subject parcel. 6. Curb, gutter, curb cuts, and tie-in paving shall be provided in conformance with City Standards along the full frontage of the property on Ocotillo and Highway 74 Frontage Road. 7. Detailed construction plans, including landscaping, irrigation, signage, exterior lighting, grading, trash storage, and fencing plans, shall be submitted through the Design Review Process for approval prior to the issuance of a building per- mit. a) b) 8. Revise building separations near carports. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) MINUTES PALM DESERT DESIGN REVIEW BOARD AUGUST 24, 1976 CITY HALL 1. The meeting was called to order at 5:00 p.m. in the Council Chambers of the Palm Desert City Hall. Members Present: George Minturn Bill Hobbs Frank Urrutia Bernard Leung (arrived at 5:15 p.m.) Mike Buccino (arrived at 5:45 p.m.) Ralston Calvert (for Jim Hill Steve Fleshman (for Paul A. Williams) Staff Present: Sam Freed It was moved by Mr. Hobbs and seconded by Mr. Minturn that the minutes of the previous meeting of August 10, 1976, be approved. Motion carried 3-0 (Hobbs, Minturn, Leung) with Urrutia abstaining. 2. CASE NO. 46MF - SILVER SPUR ASSOCIATES Review of final building plans and preliminary landscape plans for 36 condominium units from Tract 5554 south of Boxthorn Lane in the Ironwood Country Club project (PR-7). John Ballew and Don Shayler represented the applicant. This approval was actually an amendment of a previous plot plan approval (P.P. 1066) for this tract. The applicant was substituting new floor plans, while retaining the previous site plan for the tract. It was moved by Mr. Minturn and seconded by Mr. Hobbs that the plans be approved. Motion carried 3-0 (Hobbs, Minturn, Leung) with Urrutia abstaining. 3. CASE NO. 43MF - DESTINATION RESORT CORPORATION Review of final construction plans for a 28-unit condominium project in the Shadow Mountain Resort and Racquet Club. Doug Hinchliffe represented the applicant. It was moved by Mr. Minturn and seconded by Mr. Hobbs that the plans be approved with the following corrections and comments: a. the applicant's proposal for "hoods" on the tennis court lights would be approved as submitted, but would have to be revised to Department of Environmental Services staff requirements if they did not reduce glare to an acceptable level. b. Curb and gutter should not be installed on San Luis Rey at this time. c. One -bedroom units should be increased to a minimum of 1,000 square feet. d. The revised color board, Exhibit G, is approved. e. The preliminary design of the revised entrance improvements on San Luis Rey is approved, subject to DRB Process approval of detailed final construction plans (including landscaping). f. Revisions to landscape plan made by the Design Review Board. Motion carried 4-1 (Minturn, Hobbs, Leung, Urrutia) with Buccino voting no (opposed to elevations). MINUTES DESIGN REVIEW BOARD AUGUST 24, 1976 4. CASE NO. 35C - HAROLD McCORMICK Review of preliminary site plan, floor plans, and elevations for a 3,750 square foot commercial building on the north side of El Paseo, between Lupine Lane and Sage Lane. The Board felt that while the site plan was good, the elevations were too similar to other projects. It was moved by Mr. Hobbs and seconded by Mr. Buccino that the case be deferred so that the applicant could submit revised north and south elevations. Motion carried 4-0 (Hobbs, Minturn, Urrutia, Buccino) with Leung abstaining because the plans drawn by Robert Ricciardi also had his name on them. 5. CASE NO. 37MF - GLENN VENTLING Review of final construction plans for a 12-unit apartment complex on the west side of Ocotillo Drive. It was moved by Mr. Hobbs and seconded by Mr. Buccino that the plans be approved subject to Design Review Board review of final landscaping and lighting plans. Motion carried 5-0 (Hobbs, Leung, Minturn, Buccino, Urrutia). 6. CASE NO. 36C - JOE CABANYOG Review of site plan and elevations for a small commercial remodel and addition to the House of Plants on the north side of Highway 111, east of Cabrillo. It was moved by Mr. Buccino and seconded by Mr. Hobbs that the plans be approved. Motion carried 5-0 (Hobbs, Leung, Minturn, Buccino, Urrutia). 7. The staff informed the Design Review Board of subsequent City Council actions concerning the appeal of chain link fence for a residence at 74-941 Borrego Drive. In other action, Mr. Hobbs moved that a representative of the Design Review Board attend Planning Commission meetings for liason purposes, so that the Design Review Board can get a clearer reaction of the Planning Com- mission actions that is provided in the minutes of the Planning Com- mission meeting. The motion was seconded by Mr. Minturn. It was determined that the representative would be voluntary and handled on a rotating basis. Motion carried 3-0 (Hobbs, Minturn, Urrutia) with Leung abstaining. Mr. Hobbs also moved that the City Council designate alternates for the four technical members of the Design Review Board in order to have each profession represented at each meeting. The motion was seconded by Mr. Minturn. Motion carried 4-0 (Minturn, Leung, Hobbs, Urrutia). It was moved by Mr. Hobbs and seconded by Mr. Minturn that the meeting be adjourned.
