A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING
DESIGN REVIEW BOARD ACTIONS OF SEPTEMBER 21, 1976.
WHEREAS, the Planning Commission of the City of Palm Desert, did review
the Design Review Board actions of September 21, 1976, approving:
Case No. 39C - A 12,000 Square Foot Commercial Building for
J & R ENTERPRISES
Case No. 40C - A 22,000 Square Foot Commercial Building for
CHRIS HAENEL
Case No. 36MF - Modifications to a Previous Approval for JOMO
DEVELOPMENT
WHEREAS, at this time, upon receiving and considering all testimony and
arguments, if any, of all persons who desired to be heard, said Commission did
find sufficient facts and reasons to exist to approve the Design Review Board
actions of September 21, 1976; and,
WHEREAS, the Planning Commission does find that Cases No. 39C and No. 40C
are in conformance with the Redevelopment Plan for the City.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That it does hereby approve the Design Review Board actions of
September 21, 1976.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Planning Com-
mission of the City of Palm Desert, California, held on the 5th day of October,
1976, by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. 39C
1. The development of this project shall conform substantially to all develop-
ment plans submitted in behalf of this case (Exhibits A-E), and as revised
according to the Design Review Board process. Any minor changes require ap-
proval by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City,
and any other applicable government entity shall be complied with as part
of the development process.
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights -of -way and adjoining properties by
architecturally integrated means as shown.
5. All utility service lines shall be placed underground.
6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving
shall be provided in conformance with City Standards for the following:
a. The applicant shall dedicate two feet (2') on the full Portola frontage
of the site.
b. The applicant shall install a ten foot (10') wide sidewalk along the
full frontage of Portola to the specifications of the City Engineer.
7. Final landscaping (with irrigation system) plans shall be provided to the
Design Review Board for approval prior to issuance of a building permit.
8. A non-combustible trash storage area shall be provided.
9. Lighting of parking areas and premises shall be provided as approved by the
Director of Environmental Services.
10. Signage shall be provided in accordance with signage plan to be submitted to
the Design Review Board and the Planning Commission for final approval.
11. Traffic control provisions shall be provided as required by the Director of
Environmental Services.
12. Elevations are approved as modified.
13. Construction plans shall be submitted for approval to the City Fire Marshall
prior to the issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until completed.
14. A detailed grading plan shall be submitted to the City Engineer for approval.
15. The building shall be shortened by two feet (2') to compensate for the two
feet (2') of additional dedication.
16. The applicant shall agree to join any assessment district formed that includes
the subject property within its boundaries.
17. The applicant shall grant to the City of Palm Desert, easement rights over the
parking lot area of the project site.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all the
conditions set forth, and understand that the Department of Building and Safety will
not issue a permit or allow occupancy on the use permitted until this signed confir-
mation has been received by the Department of Environmental Services.

CONDITIONS OF APPROVAL
CASE NO. 40C
1. The development of this project shall conform substantially to all develop-
ment plans submitted in behalf of this case (Exhibits A-E), and as revised
according to the Design Review Board process. Any minor changes require ap-
proval by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City,
and any other applicable government entity shall be complied with as part
of the development process.
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights -of -way and adjoining properties by
architecturally integrated means as shown.

6. Curb, gutter, sidewalk, or approved pathways, curb cuts, and tie-in paving

a. The applicant shall improve the full frontage of the site on Sage Lane
at twenty feet (20') from centerline.
b. The applicant shall install ten foot (10') sidewalk along El Paseo and
Sage Lane to the specifications of the City Engineer.
7. Final landscaping (with irrigation system) plans shall be provided to the
Design Review Board process for approval prior to issuance of a building
permit. Additional landscaping in front of the building shall be provided
with a side opening.
8. A non-combustible trash storage area shall be provided.
9. Lighting of parking areas and premises shall be provided as approved by the
Director of Environmental Services.
10. Signage shall be provided in accordance with signage plan to be submitted to
the Design Review Board and the Planning Commission for final approval.
11. Traffic control provisions shall be provided as required by the Director of
Environmental Services and shall be integrated with the signage plan.
12. Elevations are approved as shown.
13. Construction plans shall be submitted for approval to the City Fire Marshall
prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until completed.
14. A detailed grading plan shall be submitted to the City Engineer for approval,
prior to construction.
15. The applicant shall agree to join any assessment district formed that includes
the subject property within its boundaries. Driveways shall be 20' (twenty foot)
in width.
16. The parking lot layout shall be re -studied to attempt to get additional land-
scaping on the perimeter of the project.
17. The street trees along El Paseo and Sage Lane shall be Ficus. Retussa.
