(PLANNED RESIDENTIAL, 4 DWELLING UNITS PER ACRE, SCENIC PRESERVATION OVERLAY) AND PC(4), S.P. (PLANNED COMMERCIAL -RESORT, SCENIC PRESERVATION OVERLAY) ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF THE INTER- SECTION OF DEEP CANYON ROAD AND HIGHWAY 111. CASE NO. C/Z 05-76 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on the 4th day of November, 1976, and a continued Public Hearing on the 30th day of November, 1976, to consider a Planning Commission initiated re -zoning from 'S' (Study) to C-1, S.P. (General Commercial, Scenic Preservation Overlay), and PC(4), S.P. (Planned Commercial -Resort, Scenic Preservation Overlay), on property generally located at the northeast corner of the intersection of Deep Canyon Road and Highway 111, and more particularly de- scribed as: APN 625-100-04 APN 625-100-05 APN 625-100-06 APN 625-100-07 APN 625-100-10 APN 625-100-11 APN 625-100-12 WHEREAS, said application has met the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that this project is considered as an on -going phase of the Zoning Map, Case No. C/Z 01-76, for which a final Environmental Impact Report was certified as complete by the City Council; and, WHEREAS, at said Public Hearings, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the approval of the Change of Zone necessary to carry out the provisions and general purposes of the Palm Desert Zoning Ordinance, in that: 1. The proposed re -zoning is in conformance with the General Plan of the City of Palm Desert, California, as recently amended. 2. The proposed re -zoning meets the intent of the Redevelopment Plan of the City of Palm Desert, California, in that the area in question is noted as Core Area Commercial, and the range of uses in the Planned Residential zone does allow compatible uses, such as hotels and restaurants. Planning Commission Resolution No. 197 3. The proposed zoning designations conform to the adjacent zoning and would provide for compatible development in relationship to the surrounding area if specific concern is provided for the area adjacent to Deep Canyon Road in close proximity to the existing residential lots which are located on the west side of Deep Canyon Road, northerly of Alessandro Drive. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend approval of the attached Ordinance to the City Council which would result in the approval of the Change of Zone request from 'S' (Study) to PR(4), S.P. (Planned Residential, 4 Units Per Acre, Scenic Preservation Overlay), and PC(4), S.P. (Planned Commercial -Resort, Scenic Pre- servation Overlay) as described on the drawing attached to the proposed Ordinance for the reasons set out in this resolution. C/Z 05-76 The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1: Section 25.46 of the Palm Desert Municipal Code, the Zoning Map, is hereby amended to Change the Zone of a 15 acre parcel of land located on the north side of Highway 111 between Deep Canyon Road and the Indian Wells City Limit, from `S' (Study) to C-1, S.P. (General Commercial, Scenic Preserva- tion Overlay) and PC(4), S.P. (Planned Commercial -Resort, Scenic Preservation Overlay), as indicated on the attached Exhibit "A". SECTION 2: This Ordinance is hereby declared to be an Urgency Ordinance, effective immediately upon passage, pursuant to Section 36937 of the State Govern- ment Code because such an action is necessary to preserve the public welfare and safety because unless such an action is taken, this property would have no meaning- ful zoning designation until new hearing procedures could be conducted which would be in conflict with the City's Ordinances. SECTION 3: The City Clerk of the City of Palm Desert, California, is hereby directed to cause this Ordinance to be published within fifteen (15) days of adoption in the Palm Desert Post, a newspaper published and circulated within the City of Palm Desert, California.
