HomeMy WebLinkAboutRes No 204PLANNING COMMISSION RESOLUTION NO. 204 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROV- ING THE DESIGN REVIEW BOARD ACTIONS OF DECEMBER 7, 1976. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of December 7, 1976, approving: Case No. 38C - Construction drawings for a new commercial building for SANDY SIERRA NEVADA, INC.; Case No. 26C - Construction drawings for a new commercial building for SANDY SIERRA NEVADA, INC.; Case No. 31MF - Construction drawings for a new apartment complex on Panorama, for DWIGHT BABCOCK; Case No. 49MF - Construction drawings for the final phase of INDIAN HILLS for HERITAGE-DUNPHY ASSOCIATES; Case No. 30C - Preliminary drawings for a new commercial building for N. W. DeVOE, LTD.; Case No. 43C - Preliminary drawings for a new commercial complex for CURT DUNHAM; Case No. 50MF - Drawings for nine new homes on Haystack Road for EUCLID-BALL COMPANY; Case No. 51MF - Drawings for the remodel of an existing sales office for RALPH ADAMS/SANDPIPER. WHEREAS, at this time, upon receiving and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of December 7, 1976. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case; 2) That it does hereby approve the Design Review Board actions of December 7, 1976, at attached and amended as follows: Case No. 50MF, Condition No. 7, amended to read: "The pad elevations as shown are rejected. A revised grading plan shall be prepared to lower the pads to the maximum amount possible consistent with the City's Grading Standards. The final grading plan shall be subject to the approval of the City Engineer." -1- Planning Commission Resolution No. 204 Condition No. 9 added to require sidewalks. Condition No. 10 added to reduce the roof pitch to 3 in 12 on the three westerly units. 3) Case No. 19SA, is sent back to the Design Review Board for further study and additional information as follows: a) complete landscape plan; b) relocation of the "RR" to be integrated into the face of the sign. PASSED, APPROVED, and ADOPTED at a regularly scheduled Palm Desert Planning Commission meeting, held on the 14th day of December, 1976, by the following vote, to wit: AYES: BERKEY, KELLY, READING, WILSON NOES: NONE ABSENT: MILLS ABSTAIN: NONE ATTEST: STEPHE' A. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-Z), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. No roof top air conditioning equipment shall be allowed. 5. Curb, gutter, curb cuts, tie-in paving, and sidewalk shall be provided in conformance with City Standards along the full frontage of the pro- perty on Portola Avenue to the centerline of the street, to the speci- fications of the City Engineer. 6. A street light shall be provided to the specifications of the City Engineer. 7. All off -site improvements shall be made as a part of the first phase. 8. The air conditioning compressors shall be relocated out of the patio areas. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) Planning Commission Resolution No. 204 December 14, 1976 CONDITIONS OF APPROVAL CASE NO. 30C 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-C), and as revised according to the Design Review Board Process. Any minor changes require approval by the Director of Environmental Services. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by architecturally integrated means as shown. 5. The applicant shall post a cash deposit for the pro-rata share of the cost of undergrounding the overhead utility lines at the rear of the subject property prior to occupancy of the building. 6. Sidewalk shall be provided in conformance with City Standards along the Frontage Road. 7. Final landscaping (with irrigation system) plans shall be provided to the Design Review Board for approval prior to the issuance of a building permit. 8. A non-combustible trash storage area shall be provided. 9. Lighting of the parking areas and premises shall be provided as approved by the Director of Environmental Services. 10. Signage shall be provided in accordance with signage plan to be submitted to the Design Review Board and the Planning Commission for final approval. 11. Traffic control provisions shall be provided as required by the Director of Environmental Services. 12. Construction plans shall be submitted for approval to the City Fire Marshall prior to the issuance of building permits. All conditions shall be made a part of the construction and no certificate of occupancy shall be issued until completed. 13. A detailed grading plan shall be submitted to the City Engineer for approval. 14. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 15. The applicant shall grant to the City of Palm Desert, easement rights over the parking lot area of the project site. 16. The parking lot layout shall be revised to conform with a 90° parking layout & shall be approved by Staff encompassing the total 100 feet. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-F), and as revised according to the Design Review Board Process. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by architecturally integrated means as shown. 5. All utility service and distribution lines shall be placed underground. 6. Curb cuts shall be provided in conformance with City Standards. 7. The applicant shall install sidewalk along the Frontage Road and Sage Lane to the specifications of the City Engineer. 8. Lighting of parking areas and premises shall be provided as approved by the Director of Environmental Services. 9. Traffic control provisions shall be provided as required by the Traffic Engineer. 10. Elevations are approved as shown. 11. Construction plans shall be submitted for approval to the City Fire Marshall prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until com- pleted. 12. A detailed grading plan shall be submitted to the Building Official Process for approval prior to construction. 13. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 14. The applicant shall grant to the City of Palm Desert, easement rights over the parking lot area of the project site. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-P), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. No roof top air conditioning equipment shall be permitted. 5. All service utility lines shall be placed underground. 6. Final landscaping, irrigation, and fencing plans shall be submitted and installed prior to occupancy. 7. The pad elevations as shown are rejected. A revised grading plan shall be prepared to lower the pads to the maximum amount possible consistent with the City's Grading Standards. The final grading plan shall be sub- ject to the approval of the City Engineer. 8. Garages shall be expanded to be a minimum of 20' x 20' inside dimensions. 9. Sidewalk shall be provided to the specifications of the City Engineer. 10. The roof pitches shall be reduced in 'C' plan to 3 in 12 on the three westerly -most lots. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building & Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by means of screening as shown. 5. All service utility lines shall be placed underground. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issus a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
