A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE
CITY COUNCIL OF AN AMENDMENT TO ARTICLE 41 OF THE PALM
DESERT ZONING ORDINANCE, AS ADOPTED BY ORDINANCE 99.
CASE NO. ZOA 01-77
WHEREAS, the Planning Commission, did on the 25th day of January, 1977,
hold a duly noticed Public Hearing to consider an Amendment to Article 41 of the
Palm Desert Zoning Ordinance, filed by the City of Palm Desert, to revise the
procedures for the implementation of the California Environmental Quality Act of
1970; and,
WHEREAS, at said Public Hearing, upon hearing and considering the testi-
mony and arguments, if any, of all persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist which make the ap-
proval of the Zoning Ordinance Amendment necessary:
1) The proposed project does conform to the California Environmental
Quality Act of 1970 (Section 21000 et seq. Public Resources Code) and the Guide-
lines for the Implementation of CEQA.
2) The proposed project does insure the protection of the public health,
safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1) That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2) That it does hereby recommend approval to the City Council of the
attached Zoning Ordinance Amendment for Article 41, Chapter 25, Palm Desert Muni-
cipal Code, for the reasons set out in this resolution.
PASSED, APPROVED, and ADOPTED at a special meeting of the Planning Com-
mission of the City of Palm Desert, California, held on this 25th day of January,
1977, by the following vote, to wit:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING ORDINANCE 99, SPECIFICALLY ARTICLE 41
OF THE PALM DESERT ZONING ORDINANCE DEALING WITH ENVIRONMENTAL
IMPACT REPORT REQUIREMENTS. CASE NO: ZOA 01-77
The City Council of the City of Palm Desert, California, DOES HEREBY
ORDAIN as follows:
SECTION 1: That portion of Ordinance 99 referencing Article 41 of the
Zoning Ordinance (Chapter 25.41 of the Palm Desert Municipal Code) is hereby
repealed.
SECTION 2: Article 41 of Ordinance 99 is hereby amended to read as
follows:
ARTICLE 25.41 ENVIRONMENTAL IMPACT REPORT REQUIREMENTS
25.41-1 Intent and Purpose
It is the intent of this Article to relate the provisions of this Ordi-
nance and all other applicable projects to the appropriate City pro-
visions that have been adopted in order to comply with the California
Environmental Quality Act of 1970 and subsequent standards as established
by the State Legislature, the Secretary of Resources, and the City of Palm
Desert..
25.41-2 Scope of Regulations
This Article shall be applied pursuant to the adopted "Resolution of the
City Council of the City of Palm Desert Establishing Procedures to Implement
the Environmental Quality Act of 1970", as amended.
SECTION 3: The City Clerk of the City of Palm Desert, California, is
hereby directed to publish this Ordinance once in the Palm Desert Post, a newspaper
of general circulation., published and circulated in the City of Palm Desert, Cali-
fornia, and shall certify to the passage and adoption of this Ordinance, and the
same shall be in full force and effect thirty (30) days after its adoption.

Desert, California, this 24th day of February, 1977, by the following vote, to wit:
