HomeMy WebLinkAboutRes No 219PLANNING COMMISSION RESOLUTION NO. 219 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF FEBRUARY 8, 1977. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of February 8, 1977, approving: Case No. 48C Request for preliminary approval of the floor plan, site plan, and elevations for a commercial addition for UNITED CALIFORNIA BANK; Case No. 55MF Request for approval of final construction drawings for a 26-unit apartment building for AFFILIATED CON- STRUCTION; Case No. 57MF - Request for approval of preliminary site, floor, and elevation plans for a 6-unit apartment project for JIM BELKNAP; Case No. 58MF - Request for approval of preliminary site plan and elevations for a storage building and golf cart parking structure for SHADOW MOUNTAIN GOLF CLUB; Case No. 59MF - Request for approval of final construction drawings for an admission and office building for the LIVING DESERT RESERVE; WHEREAS, at this time, upon considering and receiving all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of February 8, 1977. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case; 2) That it does hereby approve the Design Review Board actions of February 8, 1977. PASSED, APPROVED, and ADOPTED at a regularly scheduled meeting of the Palm Desert Planning Commission, held on this 15th day of February, 1977, by the following vote, to wit: AYES: BERKEY, KELLY, MILLS, READING, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: 1 PAUL A. 6ttLIAMS, SECRETARY PALM DESERT PLANNING COMMISSION February 8, 1977 CONDITIONS OF APPROVAL CASE NO. 48C 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-C), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Landscaping (with irrigation system) shall be approved by the Director of Environmental Services for installation prior to final inspections. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building & Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) February 8, 1977 CONDITIONS OF APPROVAL CASE NO. 55MF 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-N), and as revised according to the Design Review Board process. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Design Review Board and the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service lines for utilities shall be placed underground. 5. No roof top air conditioning equipment shall be permitted unless architec- turally obscured from sight from adjacent property and public rights -of - way. 6. Perimeter screening in the form of fencing and landscaping shall be pro- vided as approved by the Design Review Board. A 5' masonry block wall shall be added adjacent to Candlewood and Shadow Mountain Drive. 7. 8" curb, gutter, curb cuts, and tie-in paving along the full frontage of the property on Candlewood and Shadow Mountain Drive shall be provided for by means of installation prior to final inspection. Construction shall com- form to City Standards and all requirements of the City Engineer. The ap- plicant shall dedicate additional right-of-way along Candlewood and Shadow Mountain Drive in accordance to the requirements of the City Engineer. 8. Elevations are approved as shown. 9. Sewer hookup shall be made if mains exist within 200' of the property. If cesspool/septic tank system is approved, applicant shall install a dry sewer line connection from dwelling units to front property line. 10. Dead end driveway before reaching Lantana and place remaining property in landscaping. Design of revised driveway shall be subject to approval of the City Fire Marshall. 11. Applicant shall not remove any existing mature trees on the site, unless replaced by equivalent number of field -grown specimen trees. The applicant shall utilize grass as ground cover for landscaped area adjacent to Candle - wood and Shadow Mountain Drive and shall relocate the easterly olive tree to avoid line -of -sight conflicts. 12. Landscape private patio areas to the satisfaction of the Director of Environ- mental Services. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building & Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) February 8, 1977 CONDITIONS OF APPROVAL CASE NO. 57MF 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-F), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All overhead utility distribution lines along the rear property line shall be placed underground as a part of construction. 5. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided on the frontage road of Highway 74 in conformance with City Standards and the requirements of the City Engineer. 6. Complete and detailed construction drawings, including landscaping, ir- rigation, revised trash storage and wash facilities, lighting, fencing, and signage plans, shall be submitted for Design Review Board process ap- proval prior to submittal for building plan check. Restudy entryway de- sign. 7. The applicant shall redesign parking layout to allow access for vehicles coming from the lot to the north (Calypso Apartments) also owned by the applicant and shall record an access easement in a manner acceptable to the City Attorney. 8. The proposed parking area design is not approved. Said area shall be redesigned to be integrated with existing apartment complex to the east and better location of proposed trash storage area. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) February 8, 1977 CONDITIONS OF APPROVAL CASE NO. 58MF 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A & B), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All utility service lines shall be placed underground. 5. Add oleanders along south and west walls to screen storage building. 6. Move storage building fifteen (15) feet to the east. 7. Building shall be redeisgned to have only one vehicle door, which will be located on east end of structure. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building & Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) February 8, 1977 CONDITIONS OF APPROVAL CASE NO. 59MF 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-P), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service lines for utilities shall be placed underground. 5. Landscaping (with irrigation system) shall be provided as shown. 6. Signage shall be provided in accordance with signage plan to be submitted to the Design Review Board for final approval. All existing signs in the public right-of-way shall be removed prior to construction. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Buidling and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
