HomeMy WebLinkAboutRes No 221PLANNING COMMISSION RESOLUTION NO. 221 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF FEBRUARY 22, 1977. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of February 22, 1977, approving: Case No. 50C - Request for preliminary approval of the floor plan, site plan, and elevations for a commercial building for DR. CRAINE; Case No. 30C - Request for approval of final construction drawings for a commercial building for N. W. DeVOE; Case No. 56MF - Request for approval of final construction plans for a 7-unit apartment project for JIM BELKNAP; Case No. 58MF - Request for modification of site plan and elevations for a storage building and golf cart parking structure for SHADOW MOUNTAIN GOLF CLUB; Case No. 60MF - Request for approval of final construction drawings for an 8-unit apartment complex for F. S. & L. INDUSTRIES; Case No. 61MF - Request for preliminary site, floor, and elevation plans approval for a duplex for 0. M. HOMME; WHEREAS, at this time, upon considering and receiving all testimony and argu- ments, if any, of all interested persons desiring to be heard, said Planning Commis- sion did find sufficient facts and reasons to exist to approve the Design Review Board actions of February 22, 1977. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, Calfiornia, as follows: 1) that the above recitations are true and correct and constitute the findings of the Commission in this case; 2) that it does hereby approve the Design Review Board actions of February 22, 1977. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 1st day of March, 1977, by the following vote, to wit: AYES: KELLY, MILLS, READING, WILSON NOES: NONE ABSENT: BERKEY ABSTAIN: NONE ROY WI ; CHAIRMAN ATTEST: PAUL A. WILLIAMS, SECRETARY PALM DESERT PLANNING COMMISSION February 22, 1977 CONDITIONS OF APPROVAL CASE NO. 50C 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A & B), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by landscaping or ar- chitecturally integrated means. 5. All service utility lines shall be placed underground, unless approved otherwise by the Director of Environmental Services. 6. The applicant shall provide a cash deposit for a pro rata share of the cost of undergrounding the overhead distribution lines along the rear of the subject property prior to issuance of a certificate of occu- pancy. 7. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving shall be provided in conformance with City Standards and the requirements of the City Engineer. 8. Traffic control provisions shall be provided as required by the Director of Environmental Services. 9. Elevations are not approved as shown and shall be modified according to annotated changes. 10. A complete and detailed set of final construction drawings, including but not limited to signage, revised trash storage, parking lot lighting, land- scaping, and irrigation plans, shall be submitted for Design Review Board Process approval prior to submittal of plans for building permits. 11. The applicant shall submit to the City of Palm Desert a public easement covering the parking area of the subject Lot 12 prior to issuance of certificate of occupancy. 12. The property owner shall agree to join any assessment district formed that includes the subject property within its boundaries. 13. The easterly parking space adjacent to the alley shall be deleted as it is not in conformance to the Zoning Ordinance, which will leave a total of eighteen (18) spaces approved. 14. All projections into the public right-of-way shall conform to the Uniform Building Code and a five (5) foot setback shall be maintained for all bearing walls and columns along the El Paseo frontage. 15. An additional six (6) inches of space shall be provided between the alley parking spaces and the north wall of the building. 16. The west wall of the building shall be treated with stucco and painted to match other walls. AGREEMENT I accept and agree, prior to use of this permit or approval, to cpmply with all the conditions set forth, and understand that the Department of Building & Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) Applicant's Signature) February 22, 1977 CONDITIONS OF APPROVAL CASE NO. 30C 1. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-C), and as revised according to the Design Review Board Process. Any minor changes require approval by the Director of Environmental Services. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by architecturally integrated means as shown. 5. The applicant shall post a cash deposit for the pro-rata share of the cost of undergrounding the overhead utility lines at the rear of the subject property prior to occupancy of the building. 6. Sidewalk shall be provided in conformance. with City Standards along the Frontage Road. 7. Final landscaping (with irrigation system) plans shall be provided to the Design Review Board for approval prior to the issuance of a building permit. 8. A non-combustible trash storage area shall be provided. 9. Lighting of the parking areas and premises shall be provided as approved by the Director of Environmental Services. 10. Signage shall be provided in accordance with signage plan to be submitted to the Design Review Board and the Planning Commission for final approval. 11. Traffic control provisions shall be provided as required by the Director of Environmental Services. 12. Construction plans shall be submitted for approval to the City Fire Marshall prior to the issuance of building permits. All conditions shall be made a part of the construction and no certificate of occupancy shall be issued until completed. 13. A detailed grading plan shall be submitted to the City Engineer for approval. 14. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 15. The applicant shall grant to the City of Palm Desert, easement rights over the parking lot area of the project site. 16. The parking lot layout shall be revised to conform with a 90° parking layout & shall be approved by Staff encompassing the total 100 feet. AGREEMENT I acbept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits H-V), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service lines for utilities shall be placed underground. 5. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided on Ocotillo Drive in conformance with City Standards and the require- ments of the City Engineer. 6. Storage facilities shall be provided in all carports. 7. A masonry trash enclosure shall be provided south of the driveway entrance and integrated into the design of the adjacent perimeter wall. Enclosure design shall conform to all requirements of Ordinance 88. 8. A minimum ten (10) foot setback shall be provided between the carport structures and any adjacent building. 9. A joint use agreement, in a form acceptable to the City Attorney, shall be provided to the Director of Environmental Services prior to the issuance of building permits. 10. Revise colors in the 6 units on Highway 74. Landscape revisions as noted on Exhibit J. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits C & D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All utility service lines shall be placed underground. 5. Add oleanders along south and west walls to screen storage building. 6. The building shall be shifted to the north to permit the maximum landscape area south of the building, consistent with the required turning radius at the northwest corner of the building. 7. Building shall have two (2) vehicle doors which will be located on east and west ends of the structure. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to the requirements of Variance 03-76 and to all development plans submitted in behalf of this case (Exhibits A-H), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All air conditioning compressors shall be fully concealed from view from any public rights -of -way and adjoining properties by landscaping or archi- tecturally integrated means. 5. All service utility lines shall be placed underground. 6. Curb, gutter, curb cuts, and tie-in paving shall be provided in conformance with City Standards and the requirements of the City Engineer. 7. Landscaping (with irrigation system) shall be provided as modified for installation prior to final inspections. 8. A non-combustible trash storage area shall be provided as shown on the modified site plan. 9. Lighting of parking areas and premises shall be provided for as approved by the Director of Environmental Services. 10. Traffic control provisions shall be provided as required by the Director of Environmental Services. 11. Elevations are approved as shown. 12. Storage facilities shall be provided in all carports. 13. An eight (8) foot setback shall be provided on the south boundary of Lot 16. 14. Delete the Italian Cyprus from the landscape plan and replace with two 24-inch box trees per lot, using Rhus Lancia, Brazilian Pepper, or African Sumac. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environ- mental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-D), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. There shall be no roof mounted air conditioning equipment. All air con- ditioning compressors shall be fully concealed from view from any public rights -of -way and adjoining properties. 5. All service utility lines shall be placed underground. 6. Curb, gutter, curb cuts, and tie-in paving shall be provided in with City Standards and the requirements of the City Engineer. 7. Traffic control provisions shall be provided as required by the of Environmental Services. 8. Elevations are approved as shown. 9. Prior to submittal for building permits, the applicant shall submit final construction drawings for Design Review Board Process approval including but not limited to detailed landscaping, irrigation, trash storage, fencing, exterior lighting, and amenities plans. 10. This approval shall be invalid unless a modified Development Plan is adopted. 11.
