A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TENTATIVE
MAP TO ALLOW FOR DEVELOPMENT OF A 50-LOT SUBDIVISION ON
8.94 ACRES OF LAND, GENERALLY LOCATED NORTHERLY OF AND
ADJACENT TO THE INTERSECTION OF PARK VIEW DRIVE AND FAIR -
HAVEN DRIVE.
CASE NO. TRACT 9396
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did receive a verified application from PRELUDE DEVELOPMENT INC. requesting
approval of a 50-lot condominium subdivision on 8.94 acres of land, located in
the PR-7,S.P. Zone District and situated northerly of and adjacent to the inter-
section of Park View Drive and Fairhaven Drive, and more particularly described
as:
A portion of Parcel 1, as shown
on map recorded in Book 51, Page 57,
of Record of Survey, Riverside County Records
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that
an Environmental Assessment has been made, a Negative Declaration has been issued
and the appeal period has expired; and,
WHEREAS, the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies; and,
WHEREAS, the Planning Commission did find that the subject Tentative Map
does comply with the adopted Palm Desert General Plan; and,
WHEREAS, the Planning Commission did find that the subject Tentative Map
does substantially comply with the City of Palm Desert Code, and the State of
California Subdivision Map Act, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That it does hereby recommend approval to the City Council of the City
of Palm Desert, California, of the above described Tentative Map No. 9396, subject
to the fulfillment of the attached conditions of approval.
FURTHER, BE IT RESOLVED that the recommended Conditions of Approval do
include a recommendation to the City Council that they require compliance to Article
26.15 of the City's Subdivision Ordinance by the payment of a fee as specified by
Planning Commission Resolution No. 223
recommended Standard Condition of Approval No. 17.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 15th day of March, 1977, by the following vote,
to wit:

CONDITIONS OF APPROVAL
CASE NO. TRACT 9396
I. STANDARD CONDITIONS:
1. All improvements shall conform to the requirements of the City Standard
Specifications and the City Engineer.
2. Tract shall be processed in accordance with all applicable provisions of
Ordinance 125, the Subdivision Ordinance.
3. Access rights on Park View Drive shall be offered to the City as a dedi-
cation on the Final Map.
4. Prior to submittal of the Final Map, the applicant shall provide the City
with a list of proposed street names with at least three alternatives.
The approval of the final street names shall be made by the Director of
Environmental Services.
5. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
6. Prior to approval of the final map and improvement plans, a grading plan
of the tract shall be submitted to the City Engineer for approval.
7. The C. C. & R's for this development shall be submitted to the City Attorney
for review and approval prior to the issuance of any building permits. Prior
to recordation of the final subdivision map, the applicant shall submit to
the Director of Environmental Services the following documents which shall
demonstrate to the satisfaction of the Planning Commission that the total
project will be developed and maintained in accordance with the intent and
purposes of the approval:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into with the owners
of the units of the project.
8. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings, and adequate fire hydrants with required fire flows shall be
installed as recommended by the Fire Department.
9. The water system shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that
the design of the water system of Tract No. 9396 is in accordance with the
requirements prescribed by the City Fire Marshall.".
10. Improvement plans for water and sewer system shall meet the requirements
of the respective service districts.
11. All on -site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services.
12. Complete plans and specifications shall be submitted as required for
checking and approval, before construction of any improvements is commenced.
The subdivider shall submit the original drawings revised to reflect as -built
conditions, prior to acceptance of the subdivision improvements by the City
of Special District.

13. All dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free
of all liens and encumbrances.
14. All required public improvements and dedications shall be made as a part
of the Final Map on the property shown as Tract No. 9396.
15. Area shall be annexed to Improvement Districts No. 54 and No. 80 of the
Coachella Valley County Water District.
16. Install full public improvements as required by ordinance and the City
Engineer.
17. In compliance with Article 26.15 of the City's Subdivision Ordinance, the
public facilities requirement shall be met by the paying of a fee in an
amount determined under the Ordinance provisions.
18. All requirements of the Planning Commission action on the Development Plan
known as Case No. DP 04-77 shall be met as a part of the development of this
tract.
19. Drainage shall be subject to approval of the City Engineer. Applicant shall
provide engineering data as requested.
20. All private streets shall be inspected by the Engineering Department and
a Standard Inspection Fee shall be paid.
21. Install street lights along frontage of Park View as approved by the City
Engineer.
II. SPECIAL CONDITIONS
1. The total number of dwelling unit lots shall be limited to fifty (50).
2. Provide additional right-of-way on the northerly side of Park View
Drive as follows:
62' total half width easterly of Fairhaven
52' total half width westerly of Fairhaven
Developer shall install improvements for pedestrian, bicycle, and land-
scape purposes as required by the City and shall be responsible for the
maintenance of any landscaping approved for said area.
3. Install a water system capable of delivering 2,250 GPM fire flow from
any fire hydrant for a two-hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time of
measurement.
4. Install Riverside County super fire hydrants located at each street
intersection (a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted orange.
B. Curbs shall be painted red 15 feet in either direction from each
hydrant.
5. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire Marshall
for review.

6. Provide a second entrance for use by emergency vehicles and residents
in emergency situations.
7. The proposed northerly portion of the private roadway shall have a
minimum width of twenty-eight (28) feet.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth and understand that the Department of Building and Safety
will not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.

Provide the following fire protection in accordance:

This area lies on the Whitewater River flood plain and is protected from
stormwater flows by the Whitewater River Stormwater Channel and dikes built
and maintained by this District. This area may be considered safe from
stormwater flows except in rare instances.
The District will furnish domestic water service to said area in accordance
with the currently prevailing regulations of this District.
This area shall be annexed to Improvement Districts Nos. 54 and 80 of the
Coachella Valley County Water District for sanitation service.
