A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING
AN AMENDMENT OF CUP 08-76 (PLANNING COMMISSION RESOLUTION
NO. 172), WHICH APPROVED A TELEVISION BROADCASTING FACILITY
ON PROPERTY LOCATED GENERALLY ON THE NORTH SIDE OF PARK VIEW
DRIVE WESTERLY OF MONTEREY AVENUE.
CASE NO. CUP 08-76 (AMEND)
WHEREAS, the Planning Commission of the City of Palm Desert, California,
by Planning Commission Resolution No. 172, dated August 31, 1976, and subse-
quently confirmed by the City Council Resolution 76-123, dated September 29, 1976,
did grant a Conditional Use Permit to DESERT EMPIRE TELEVISION CORPORATION to allow
construction of a television broadcasting station and office complex on property
located in the PR-7,S.P. Zone District, and situated on the north side of Park
View Drive west of Monterey Avenue, and more particularly described as:

WHEREAS, the applicant has filed a request for an Amendment to revise
the approved site plan and building design; and,
WHEREAS, the Planning Commission did on March 1, 1977, as a part of a duly
noticed Public Hearing, require revisions to the proposed Amendment; and,
WHEREAS, the Public Hearing was continued to April 5, 1977, and the
applicant has submitted revised plans in conformance with the requests of the
Planning Commission which were duly considered as a part of the continued Public
Hearing at said meeting; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify the granting
of the request for the Amendment subject to some revised conditions:
1. The proposed Amendment does not affect the original findings of the
Commission in granting the original application by Planning Commission Resolution
No. 172 on the basis of the revised plans;
2. The proposed Amendment does result in the improvement of the proposed
development.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That the requested Amendment of CUP 08-76 is hereby approved subject
to the following revisions of the conditions of approval attached to Planning Com-

mission Resolution No. 172:
CONDITION NO.: REVISED TO READ AS FOLLOWS:
1 The development of the property shall conform
substantially with that shown on Exhibits D
reversed, E, F, and G (Case No. CUP 08-76) on
file with the Department of Environmental Services
unless otherwise amended by the following condi-
tions.

The requested Amendment requires the following additional Conditions of
Approval:
CONDITION NO.: TO READ AS FOLLOWS:
18 The applicant shall grant a twenty (20) foot
wide easement for the full frontage of the
property on Park View Drive to the City of
Palm Desert for pedestrian purposes free of
all liens and encumbrances. The applicant
shall be responsible to install in said ease-
ment area, an eight (8) foot wide concrete
bicycle/pedestrian way along the full frontage
of the property on Park View Drive including
a handicapped curb ramp at the intersection
of the right-of-way with the west property
line at a time determined by the City.

No signs shall be considered approved as a
part of this plan. As a part of the considera-
tion of this matter through the Design Review
Board process, all proposed signs shall be sub-
mitted for considertion by the City.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of April, 1977, by the following vote,
to wit:
