A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
RECOMMENDING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE
MAP TO ALLOW FOR DEVELOPMENT OF A 193-UNIT CONDOMINIUM
PROJECT ON 33.6 ACRES OF LAND GENERALLY LOCATED 1.5
MILES SOUTH OF STATE HIGHWAY 111, ON THE WEST SIDE OF
STATE HIGHWAY 74.
CASE NO. TRACT NO. 9377
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 1st day of March, 1977, hold a duly noticed Public Hearing, and a
continued Public Hearing on April 5, 1977, to consider a verified application from
BIDDLE DEVELOPMENT INC. for M & T INC., requesting approval of a Tentative Tract
on a 191-unit condominium project on 33.6 acres of land, located in the PR-8
Zone District and situated 1.5 miles south of State Highway 111, on the west
side of Highway 74, and more particularly described as:
Being a portion of Government Lot 1 in the NW1
of Section 31, and a portion of the W2 of the NE4
of Section 31, T5S, R6E, SBB & M
WHEREAS, said application was exempt from the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that
the project was initiated prior to the effective date of the California Environ-
mental Quality Act and is therefore considered to be exempt as an on -going pro-
ject; and,
WHEREAS, the Planning Commission did take into consideration the Ten-
tative Map as submitted, and the reports of the various reviewing agencies; and,
WHEREAS, the Planning Commission, upon hearing and considering the testi-
mony and arguments, if any, of all interested persons desiring to be heard, did
find the following facts and reasons to exist which make approval of the above -
described Tentative Map necessary:
1. The Tentative Tract Map does substantially comply with the City of
Palm Desert Code and the State of California Subdivision Map Act, as amended;
2. The Tentative Tract Map does comply with the adopted Palm Desert
General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That the Planning Commission is recommending that the City Council
require in compliance to Article 26.15 of the City's Subdivision Ordinance, the
Case No. Tract No. 9377 Planning Commission Resolution No. 227
payment of a fee as specified by recommended Standard Condition of Approval
No. 17;
3. That it does hereby recommend approval of said Tentative Tract
No. 9377 for a 193-unit condominium development to the City Council of the City
of Palm Desert of the above described Tentative Map No. 9377, subject to fulfill-
ment of the attached conditions of approval; on the basis of revocation of the
previous action on Tract No. 4442.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of April, 1977, by the following vote,
to wit:

CONDITIONS OF APPROVAL
CASE NO. TRACT 9377
I. STANDARD CONDITIONS
1. Full public improvements including paving, curb, gutter, pedestrian
and bicycle systems, street landscaping, standard street signing,
street lights, sewer, water and drainage facilities, and necessary
appurtenances shall be installed as required by ordinance, these
conditions, and the City Engineer.
2. Tract shall be processed in accordance with all applicable provisions
of Ordinance 125, the Subdivision Ordinance.
3. Access rights on the common lot abutting Highway 74 shall be offered
to the City as a dedication on the Final Map.
4. Prior to submittal of the Final Map, the applicant shall provide the
City with a list of proposed street names with at least three alterna-
tives. The approval of the final street names shall be made by the
Director of Environmental Services.
5. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
6. Prior to approval of the Final Map and improvement plans, a grading plan
of the Tract shall be submitted to the City Engineer for approval, including
diversion methods proposed for existing irrigation channels.
7. The C. C. & R's for this development shall be submitted to the City
Attorney for review and approval prior to the issuance of any building
permits. Said document shall include provisions for maintenance of the
front yard areas of all lots and common maintenance of all landscaped
areas.
8. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings, and adequate fire hydrants with required fire flows shall be
installed as recommended by the City Fire Marshall.
9. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify the design of the water system in Tract 9377 is in accordance
with the requirements prescribed by the City Fire Marshall."
10. Improvement plans for water and sewer system shall meet the requirements
of the respective service districts.
11. All on -site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view except certain appurtenances
as may be approved by the Director of Environmental Services.
12. Complete plans and specifications shall be submitted as required for
checking and approval, before construction of any improvements is
commenced. The subdivider shall submit the original drawings revised
to reflect as -built conditions, prior to acceptance of the subdivision
improvements by the City or Special District.

13. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert without cost to the City and
free of all liens and encumbrances.
14. All required public improvements and dedications shall be made as a
part of any Final Map on all or a portion of the property shown as
Tract No. 9377, except that the project may be developed in a maximum
of five (5) phases subject to the limitation specified in the condi-
tions of approval of Case No. DP 03-77.
15. Area shall be annexed to Improvement Districts No. 54 and No. 80 of the
Coachella Valley County Water District and the Coachella Valley Storm -
water District.
16. Install full public improvements as required by Ordinance and the City
Engineer.
17. In compliance with Article 26.15 of the City's Subdivision Ordinance,
the public facilities requirement shall be met by the paying of a fee
in an amount determined under the Ordinance provision.
18. All requirements of the Planning Commission action on the Development
Plan known as Case No. DP 03-77 shall be met as a part of this Tract.
II. SPECIAL CONDITIONS:
1. As a part of the development of this tract, any existing overhead utilities
either on the property or in the Highway 74 right-of-way adjacent to the
subject property shall be placed underground from the nearest poles not
abutting the subject property. Said undergrounding shall be done as a
part of the first phase of the Tract.
2. The applicant shall conform to all requirements and improvements as deemed
necessary by the City Fire Marshall.
3. Install Riverside County super fire hydrants located at each street inter-
section (a) but not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted orange.
B. Curbs shall be painted red 15 feet in either direction from each hydrant.
4. Prior to recordation of the final map, the developer shall furnish the
original and three (3) copies of the water system plan to the City Fire
Marshall for review.
5. Correct zoning indicated on the map to PR-8.
6. The possible conflicts with the existing water facilities shall be resolved
prior to recordation of the final map on the affected phase.
7. All improvements shall conform to the requirements of the City Standard
Specifications and the City Engineer.
8. All private streets shall be inspected by the Engineering Department
and a Standard Inspection Fee shall be paid.
9. Provide turn arounds at the end of all cul-de-sacs satisfactory to the
City Engineer.

10. Flood protection satisfactory to the City Engineer and the Coachella Valley
County Water District shall be provided. This will include hardening of a
portion of the Palm Valley Storm Channel.
11. Drainage shall be kept on site and conducted to the Palm Valley Storm
Channel.
12. Provisions satisfactory to the City shall be made for pedestrians and
bicycles within a 32' parkway along the Highway 74 frontage.
13. Street lighting satisfactory to the City Engineer shall be provided
along Highway 74.
14. Parking shall be prohibited on all streets less than 32' in width
and on one side of all 32' streets.
15. Desert Flower Dirve shall be paved to Highway 74 in Unit No. 3 as part
of the first unit.
16. A public access easement along the full frontage of Highway 74 to
provide the equivalent of a 32' parkway shall be offered by the ap-
plicant to the City of Palm Desert.
17. Applicant shall provide an access easement to the Bertrand property
as generally shown on Plat YK-14 and such other easements as may be
required by the City Council. An offer of dedication for public street
purposes shall also be made for said easements plus an additional five
(5) foot on each side.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building & Safety
will not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.

the appropriate public agency to withhold the issuance of a building permit
until arrangements have been made with the District for the relocation of
these facilities.

Gentlemen:
This area lies on the Dead Indian Canyon and Deep Canyon debris cone.
This area is protected from stormwater flows by a system of channels and
dikes built and maintained by this District. This area may be considered
safe from stormwater flows except in rare instances.
The District will furnish domestic water and sanitation service to said
area in accordance with the currently prevailing regulations of this
District.
The District requests that the attached Conditions of Approval be included
with the recommendations to be made to the Planning Commission.

Dear Mr. Williams:
Thank you for the opportunity to review the tentative map for
Tract No. 9377 located adjacent to the westerly side of State
Highway Route 74 between Carriage Trail and Homestead Road.
This map shows a 32' wide entrance at the northerly end of the
tract. We suggest that the entrance be at least 40' wide within
100' of the State highway.
A portion of the runoff from the proposed development is directed
towards the State highway. This additional water when combined
with upstream runoff may exceed the gutter capacity. It is
suggested that a catch basin be placed in the curb near the north
entrance road. The water collected by the catch basin could
possibly be discharged into the Palm Valley Storm Channel.
The improvements to the highway should include a left -turn lane
to all roads being used for access to this development. The
developer must obtain an encroachment permit from the District 8
office of the Department of Transportation prior to doing any
work within the State highway right of way.
It is recognized that there is considerable public concern about
noise levels adjacent to heavily traveled highways. Land
development, in order to be compatible with this concern, may
require special noise attenuation measures. Development of this
property should include any necessary noise attenuation.
This portion of Route 74 has been officially designated as a
scenic highway. It is desirable for any future development to
enhance the beauty of this scenic highway corridor.
