HomeMy WebLinkAboutRes No 228PLANNING COMMISSION RESOLUTION NO. 228 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A REQUEST FOR A CHANGE OF ZONE FROM R- 3(4) TO C-1 ON PROPERTY GENERALLY LOCATED SOUTH OF EL PASEO AND EAST OF OCOTILLO DRIVE. CASE NO. C/Z 02-77 WHEREAS, the Planning Commission did on the 5th day of April, 1977, hold a duly noticed Public Hearing to consider a Change of Zone application, filed by R. D. FULLER and T. M. HILL, from R-3(4) to C-1 on property generally located south of El Paseo and east of Octillo Drive, and more particularly described as: LOTS 2, 3, and 4, BLOCK I, PALM DESERT TRACT WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration deter- mination was made by the Department of Environmental Services on January 7, 1977, and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering the testi- mony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the approval of the Change of Zone necessary to carry out the provisions and general purpose of the Palm Desert General Plan and the Palm Desert Redevelopment Plan for Project Area No. 1: 1) The proposed Change of Zone is in conformance with the adopted Palm Desert General Plan; 2) The proposed Change of Zone would conform to existing and proposed development in the area; 3) The proposed Change of Zone would ensure the protection of the public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. that the above recitations are true and correct and constitute the findings of the Commission in this case; 2. that it does hereby recommend approval of the attached resolution to the City Council for the requested Change of Zone from R-3(4) to C-1, for the reasons set out in this resolution.
