A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CON-
DITIONAL USE PERMIT TO ALLOW A PRIVATE HEALTH AND RACQUETBALL
CLUB ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF ALES-
SANDRO DRIVE, 420 FEET EAST OF PORTOLA AVENUE.
CASE NO. CUP 02-77
WHEREAS, pursuant to the provisions of Section 25.39 of the Palm Desert
Zoning Code, the Planning Commission did on April 5, 1977, hold a duly noticed
Public Hearing to consider the application of STEPHEN HERMAN and COLIN McDERMOTT
for a Conditional Use Permit to allow a private health and racquetball club on
property located in the R-3(4) zone and situated at Alessandro Drive, 420 feet
east of Portola Aaenue, and more particularly described as:
LOTS 14 & 15, BLOCK C
PALMA VILLAGE UNIT #6
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that
the Director of Environmental Services has determined on March 15, 1977, that the
project would not have a significant impact on the environment and the appeal
period did expire on March 23, 1977; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify the granting
of said Conditional Use Permit 02-77:
The project will be a single -story structure with all activities conducted
indoors. Adequate off-street parking will be provided and the perimeter of the lot
will be screened. The project will be located within an established residential
area (across the street from a commercial zone) in which most of the major improve-
ments and utilities have already been installed. In addition, the proposed location
of the conditional use is in accord with the objectives of the Zoning Ordinance and
the purpose of the district in which the site is located. Finally, the proposed
location of the conditional use and the conditions under which it would be operated
or maintained will not be detrimental to the public health, safety, or general
welfare, or be materially injurious to properties or improvements in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert as follows:

1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That the Commission does hereby grant approval of Conditional Use
Permit No. CUP 02-77, subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of April, 1977, by the following vote,
to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 02-77
APRIL 5, 1977
1. The development of the property shall conform substantially with that
as shown on plot plan marked Exhibit 'A' on file with the Department
of Environmental Services, Case No. CUP 02-77, unless otherwise amended
by the following conditions.
2. The applicant shall conform to all requirements and improvements deemed
necessary by the City Fire Marshall, namely:
a. Install a water system capable of delivering 1250 GPM fire flow for
a two hour duration in addition to domestic or other supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the
time of measurement.
b. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along
approved vehicular travel ways.
1. Hydrants shall not be located closer than 25 feet to the building.
2. Exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
3. Curbs (if installed) shall be painted red 15 feet in either
direction from each hydrant.
3. Racquetball court #6 shown for future development shall be deleted.
4. All existing and proposed overhead utility service lines adjacent or
within the proposed development site shall be placed underground as a
part of construction.
5. The City shall require that five (5) feet of the subject parcels along
Alessandro Drive be dedicated to the City of Palm Desert without cost
to the City, and free of all liens and encumbrances.
6. The project shall be reviewed by the Palm Desert Planning Commission at some
time before April 5, 1979, in order to determine whether all conditions
agreed to by the applicant have been complied with; and the fact that the
project will not adversely affect the adjacent residential areas from the
standpoint of noise.
AGREEMENT
We accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building and Safety
will not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.
