A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING
APPROVAL OF A DEVELOPMENT PLAN TO ALLOW A 2-UNIT PLANNED
RESIDENTIAL CONDOMINIUM ON PROPERTY GENERALLY LOCATED
NORTH OF PITAHAYA STREET AND EAST OF SHADOW MOUNTAIN DRIVE.
CASE NO. DP 05-77
WHEREAS, pursuant to the provisions of Section 25.39 of the Palm Desert
Zoning Code, the Planning Commission did on April 5, 1977, hold a duly noticed
Public Hearing to consider the application of 0. MICHAEL HOMME for approval of
a Development Plan to allow a 2-unit planned residential condominium on property
located in the PR-6 zone and situated north of Pitahaya Street and east of Shadow
Mountain Drive, and more particularly described as:
APN 629-210-026
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that
the Director of Environmental Services has determined on March 15, 1977, that the
project would not have a significant impact on the environment and the appeal
period did expire on March 23, 1977; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify the granting
of approval of said Development Plan:
1. The proposed development is consistent with the City's adopted General
Plan;
2. The proposed use is similar to and compatible with those existing on
adjacent and nearby properties;
3. The design or improvement of the proposed development as modified by
the recommended conditions will be consistent with the Palm Desert Zoning Ordinance;
4. The site is physically suited for both the type of development pro-
posed and the proposed density;
5. The design of the development as amended by the recommended conditions
and the proposed improvements are not likely to cause substantial environmental
damage or have a serious effect on the public health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California as follows:

1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That the Commission does hereby approve said Development Plan No. 05-77
for 0. MICHAEL ROMME for reasons subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of April, 1977, by the following vote,
to wit:

CONDITIONS OF APPROVAL
CASE NO. DP 05-77
1. The development of the property shall conform substantially with that
as shown on plot plan marked Exhibit 'A' on file with the Department
of Environmental Services, Case No. DP 05-77, unless otherwise amended
by the following conditions.
2. The applicant shall provide an additional five (5) feet of right-of-way
along the full project frontage.
3. Installation of curbs, gutters, and tie-in paving per City requirements.
4. Grading of the site shall conform to City Standards.
5. The applicant shall connect to the Coachella Valley County Water District
sewer system upon completion of construction.
6. A four (4) to five (5) foot masonry wall shall be constructed on the north
and east property lines.
7. Prior to utilization of this Development Plan, the applicant shall agree
in writing to any conditions of approval.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building and Safety
will not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.
