HomeMy WebLinkAboutRes No 234PLANNING COMMISSION RESOLUTION NO. 234 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS OF APRIL 12, 1977. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of April 12, 1977, approving: Case No. 67MF - Preliminary site, floor, and elevation plans for a 4-Unit Apartment Complex for CLAUDE & RONALD SULLIVAN; Case No. 25SA - Approval of Tenant Signs at El Paseo Square for ROY WILLIAM CARVER; Case No. 34MF - Final Construction Plans for a 9-Unit Apartment Complex for NOE-JACK DEVELOPERS; Case No. 35MF - Final Construction Plans for a 9-Unit Apartment Complex for NOE-JACK DEVELOPERS; Case No. 52C - Final Construction Plans for a Retail/Office Building for WILLIAM STEWART; WHEREAS, at this time, upon considering and receiving all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of April 12, 1977. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the Design Review Board actions of April 12, 1977, except that Case No. 34MF and Case No. 35MF shall include a Condition of Approval requiring the installation of sidewalks. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 19th day of April, 1977, by the following vote, to wit: AYES: BERKEY, KELLY, MILLS, READING, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE R'OY WILSCHAIRMAN ATTEST: N PAUL A. WILLIAMS, SECRETARY PALM DESERT PLANNING COMMISSION April 12, 1977 CONDITIONS OF APPROVAL CASE NO. 67MF 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibits A-B), and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, com- mencing within one year from approval date and being promptly completed. 4. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided on Abronia and Sunset in conformance with City Standards and the requirements of the City Engineer. 5. Complete and detailed construction drawings, including landscaping, irrigation, trash storage and wash facilities, lighting, fencing, and signage plans shall be submitted for Design Review Board process approval prior to submittal for building plan check. 6. All service utility lines shall be placed underground. 7. The width of the first parking space near the street opening shall be eleven (11) feet to provide for more convenient access and egress. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. (Date) (Applicant's Signature) April 12, 1977 CONDITIONS OF APPROVAL CASE NO. 25SA 1. Hanging tenant signs shall be permitted only at those stores in El Paseo Square fronting on El Paseo. 2. Tenants may place hanging tenant signs only in lieu of existing wall signs, not in addition to existing wal signs. 3. Hanging tenant signs may not exceed six (6) square feet. 4. Proposed hanging tenant signs must be reviewed and approved by the Director of Environmental Services prior to placement. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibit A), and is revised according to DRB action. Any minor changes require ap- proval by the Director of Environmental Services. Any substantial change requires approval by the DRB and Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project commencing within one year from approval date and being promptly com- pleted. 4. All service lines for utilities shall be placed underground. 5. No roof top air conditioning equipment shall be permitted. 6. Landscaping (with irrigation system) shall be provided as approved by the Design Review Board and Planning Commission for installation prior to final inspection and receiving certificate of occupancy. 7. Eight -inch curb, gutter, sidewalks, curb cuts, and tie-in paving from the street centerline on Shadow Mountain Drive shall be provided for by means of installation prior to final inspection. 8. Preliminary front elevation is approved as shown. 9. Sewer hookup shall be made if mains exist within 200 feet of property. 10. The applicant shall submit a future agreement with the City of Palm Desert for a pro-rata share of the cost of undergrounding any overhead utility distribution/transmission lines adjacent to the boundaries of the subject property. Said deposit shall be submitted prior to the issuance of a certificate of occupancy. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibit A), and is revised according to DRB action. The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibit A), and as revised according to the Design Review Board process. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, com- mencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by archi- tecturally integrated means as shown. 5. All utility service and distribution lines shall be placed underground. 6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving shall be provided in conformance with City Standards for the following: a) The applicant shall install curb, gutter, and sidewalk along the full frontage of Lots 6 & 7 on Palm Desert Drive. 7. Landscaping is approved as shown on the final construction plans. Trees shall be placed in front of the masonry treatment on elevations. 8. Lighting of parking areas and premises shall be provided as approved by the Director of Environmental Services. 9. Signage shall be provided in accordance with signage plan to be submitted to the Design Review Board and the Planning Commission for final approval. 10. Traffic control provisions shall be provided as required by the Traffic Engineer. 11. The exterior of the structure shall be revised. The floor plan and store front treatment shall be retained from the preliminary plan, but the roof treatment indicated in the final plans may be utilized. Final revisions shall be re- viewed by the Planning staff prior to a hearing before the Planning Commission. 12. Construction plans shall be submitted for approval to the City Fire Marshall prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 13. A detailed grading plan shall be submitted to the City Engineer for approval. 14. The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 15. The applicant shall grant to the City of Palm Desert, easement rights over the parking lot area of the project site. 16. Parking lot improvements shall include Lots 6 & 7 and complete plans for this total site shall be submitted to the Design Review Board process for approval. The final layout of the parking lot shall conform to the Prototype Block design. The driveway from the frontate road shall extend through to the alley. 17. A complete and detailed color/material sample board shall be submitted along with construction plans for Design Review Board process approval prior to submittal for building plan check. -1- Conditions of Approval Case No. 52C April 12, 1977 Page Two 18. The landscape plan shall provide for a minimum of 20" box trees throughout the entire project. 19. The trash enclosure shall be designed to minimum specifications as contained in City Ordinances 56 and 88. 20. Wheel stops shall be removed and sidewalk or planter areas expanded.
