HomeMy WebLinkAboutRes No 239PLANNING COMMISSION RESOLUTION NO. 239 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP COVERING 9 ACRES OF LAND GENERALLY LOCATED ON THE SOUTH SIDE OF AVENUE 44 AND EAST OF HIGHWAY 111. CASE NO. PM 9851 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from R. B. Gooden requesting approval of a lot split of 9 acres of land, located in the PC(4) S.P. Zone District and situated on the south side of Avenue 44 and east of Highway 111, more particularly des- cribed as: APN 629-023-004 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration was made by the Director of Environmental Services, and the appeal period has expired; and WHEREAS, the Planning Commission did take into consideration the Tentative Parcel Map as submitted, and the reports of the various reviewing agencies; and WHEREAS, the Planning Commission did find that the subject Tentative Parcel Map does substantially comply with the City of Palm Desert Municipal Code and the State of California Subdivision Map Act, as amended; and WHEREAS, the Planning Commission did find that the subject Tentative Parcel Map does comply with the adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case; and 2) That it does hereby approve the above described Tentative Parcel Map No. PM 9851, subject to the fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED by the Palm Desert Planning Commission on this 3rd day of May, 1977, by the following vote, to wit: AYES: BERKEY, KELLY, READING, WILSON NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: PAUL A. The Tentative Parcel Map is granted for the land as described in the application and any attachments thereto, and as shown on the plot plan as revised, labeled Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as a part of any construction, including installation of the following: 3. The applicant shall conform with Conditions #3, 4, 11, and 20, from Case No. DP 01-77. a. Work in Highway 111 shall be done as required by Caltrans and the City Engineer. b. Palm Valley Drainage Channel shall be rip rapped or otherwise hardened as required by the City Engineer and Coachella Valley County Water District. c. All work shall be in accordance with requirements of the City Engineer. 4. This project shall also conform to all requirements of Case No. DP 01-77. AGREEMENT: I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
