HomeMy WebLinkAboutRes No 240PLANNING COMMISSION RESOLUTION NO. 240 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A REQUEST FOR A CHANGE OF ZONE ON PRO- PERTY GENERALLY LOCATED ON THE NORTH SIDE OF AVENUE 44 AND 250 FEET WEST OF PAINTER'S PATH. CASE NO. C/Z 04-77 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of May, 1977, hold a duly noticed Public Hearing to consider a Change of Zone application filed by Paul Moller, from PR-1, H to S.I. on property generally located on the north side of Avenue 44 and 250 feet west of Painter's Path, and more particularly described as: Portion of the S 2 of Govt. Lot 2 in the SWq of Sec. 18, T5S, R6E, S.B.B. & M. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration determination was made by the Director of Environmental Services on April 11, 1977, and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the approval of the Change of Zone necessary to carry out the provisions of the Palm Desert General Plan: 1) The Change of Zone does conform to the Palm Desert General Plan. 2) The Change of Zone will not affect the health, safety, and general welfare of the community. 3) The Change of Zone does conform to the Palm Desert Redevelopment Plan for Project Area No. 1. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case; 2) That it does hereby recommend approval to the City Council of the requested change of Zone from PR-1, H to S.I. for reasons set out in this resolution. -1- Planning Commission Resolution No. 240 PASSED, APPROVED, AND Planning Commission, held on to wit: AYES: NOES: ABSENT: ABSTAIN: ATTEST: ADOPTED at a regular meeting of the Palm Desert this 3rd day of May, 1977, by the following vote, BERKEY, KELLY, READING, WILSON NONE NONE NONE PAUL A. WILLIAMS, SECRETARY PALM DESERT PLANNING COMMISSION -2- ORDINANCE 160 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE 107, THE PALM DESERT ZONING MAP. CASE NO. C/Z 04-77 The City Council of the City of Palm.Desert, California, DOES HEREBY ORDAIN as follows: SECTION 1: That portion of Ordinance 107 referencing Section 25.46-1 of the Zoning Ordinance, the Zoning Map (Chapter 25.46 of the Palm Desert Municipal Code) is hereby amended to read as shown on the attached exhibit, labeled Exhibit 'A'. SECTION 2: The City Clerk of the City of Palm Desert, California, is hereby directed to publish this Ordinance once in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, Cali- fornia, and shall certify to the passage and adoption of this Ordinance and the same shall be in full force and effect thirty (30) days after its adoption.
