HomeMy WebLinkAboutRes No 241PLANNING COMMISSION RESOLUTION NO. 241 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CON- DITIONAL USE PERMIT TO ALLOW AN OPEN STORAGE AREA GENERALLY LOCATED NORTH OF AVENUE 44 and 250 FEET WEST OF PAINTER'S PATH. CASE NO. CUP 04-77 WHEREAS, pursuant to the provisions of Section 25.39 of the Palm Desert Zoning Code, the Planning Commission did on May 3, 1977, hold a duly noticed Public Hearing to consider the application of Paul Moller for a Conditional Use Permit to allow an open storage area on property located in the S.I. zone and situated north of Avenue 44 and 250 feet west of Painter's Path, and more parti- cularly described as: Portion of the SZ of the Govt. Lot 2 in the SW4 of Sec. 18, T5S, R6E, S.B.B. & M. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that the Director of Environmental Services has determined on April 11, 1977, that the project would not have a significant impact on the environment and the appeal period did expire on April 19, 1977; and WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit 04-77; and WHEREAS, the proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. The proposed Conditional Use complies with the goals, objective, and policies of the City's General Plan and the Redevelopment Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California as follows: 1) That the above recitations are true and correct and constitute the findings of the Commission in this case: 2) That the Commission does hereby grant approval of Conditional Use Permit No. CUP 04-77, subject to the attached conditions. The development of the property shall conform substantially with that as shown on plot plan marked Exhibit "A" on file with the Department of Environmental Services, CASE NO. CUP 04-77, unless otherwise amend- ed by the following conditions. 2. The development and use of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addi- tion to all the requirements, limitations, and restrictions of all muni- cipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 3. The Conditional Use Permit shall be reviewed on or before May 1, 1980, by the Planning Commission and thereafter as deemed necessary by the Planning Commission. All conditions required as a part of future review shall have equal force and effect as those approved at time of original approval. 4. A grading plan, fencing plan and line -of -sight analysis shall be sub- mitted to the Design Review Board for approval. 5. The south side of the existing building shall not be used for open storage. 6. Alternating five (5) and fifteen (15) gallons rhus lancea (tree type) shall be planted as a hedge on the eastern side of the open storage area. 7. Uses for this parcel shall be limited to completely screened, open yard, vehicle storage areas. 8. Drainage shall conform to the requirements of the City Engineer. 9. Approval of the Conditional Use Permit is contingent upon the City Council's approval of C/Z 04-77. AGREEMENT: I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environ- mental Services.
