A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE
CITY COUNCIL OF AN AMENDMENT TO THE SERVICE INDUSTRIAL
DISTRICT OF THE PALM DESERT ZONING ORDINANCE.
CASE NO. ZOA 02-77
WHEREAS, the Planning Commission did on the 3rd day of May, 1977, hold a
duly noticed Public Hearing to consider an Amendment of Article 25.20 of the Palm
Desert Zoning Ordinance to require a Conditional Use Permit for any Service In-
dustrial project located in a Redevelopment Project Area; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that an
Environmental Assessment Form was submitted and a Negative Declaration Determination
was made by the Department of Environmental Services on April 11, 1977, and the
appeal period has expired; and
WHEREAS, at said Public Hearing, upon hearing and considering the testimony
and arguments, if any, of all persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist which make the approval of the
Zoning Ordinance Amendment necessary to carry out the provisions and general pur-
pose of the Palm Desert Zoning Ordinance:
1) Service Industrial uses require greater degree of control to minimize
adverse effects on adjacent commercial resort projects, which would be in keeping
with the intent and purpose of the Palm Desert General Plan and Redevelopment Plan;
2) The Amendment would ensure the protection of the public health, safety,
and general welfare by more carefully regulating developments located near moun-
tainous areas.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1) That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2) That it does hereby recommend approval to the City Council of the
attached Ordinance for the requested Zoning Ordinance Amendment for the reasons
set out in this resolution.
