HomeMy WebLinkAboutRes No 252PLANNING COMMISSION RESOLUTION NO. 252 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A CASE REVIEWED BY THE DESIGN REVIEW BOARD ON JUNE 7, 1977. CASE NO. 76MF WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the following case previously reviewed by the Design Review Board at their meeting of June 7, 1977: Case No. 76MF - Preliminary and Final Site, Floor, and Elevation Plans for a 193-Unit Condominium Project for BIDDLE DEVELOPMENT CORPORATION; WHEREAS, the Planning Commission did review the following concerns which were forwarded to the Commission by the Design Review Board regarding the above case: 1. That the applicant explore the feasibility of solar heating for all proposed swimming pools. 2. That all units within 150 feet of the property line along Highway 74 be limited to single story. 3. That the landscaping plan not be approved at this time. Said plan shall be considered by the Design Review Board prior to issuance of any occupancy permit. WHEREAS, at this time, upon considering and receiving all testimony and arguments, if any, from all interested persons desiring to be heard, said Commission did find sufficient facts and reasons to exist to approve Case No. 76MF, subject to the incorporation of the Design Review Board's concerns into the Conditions of Ap- proval NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve Case No. 76MF, subject to the Conditions of Approval, as attached, with the following changes: An additional condition, Condition No. 10 shall be added to read as follows: "10. All units located within 150 feet of the property line along Highway 74 shall be limited to single story in height." A revised Condition No. 7 to read as follows: "7. The applicant shall explore the feasibility of using solar energy to heat all swimming pools." 3. That this approval does not constitute final approval of the land- scaping plan. Case No. 76MF Planning Commission Resolution No. 252 4. That this approval in no way affects the status of the approved Tract Ma.p or Development Plan previously approved for this case. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 14th day of June, 1977, by the following vote, to wit: AYES: KELLY, KRYDER, READING, SNYDER, BERKEY NOES: NONE ABSENT: NONE ABSTAIN: NONE GEORGE BERKEY, CHAIRMAN ATTEST: PAUL A. WILLIAMS, SECRETARY PALM DESERT PLANNING COMMISSION Planning Commission Resolution No. 252 Case No. 76MF June 14, 1977 CONDITIONS OF APPROVAL CASE NO. 76MF 1. The development of this project shall conform substantially to all requirements of TT 9377 and DP 03-77 and to all development plans submitted in behalf of this case (Exhibits A-G), and as revised according to the Design Review Board process. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service and distribution lines for utilities shall be placed underground. 5. No roof top air conditioning equipment shall be permitted. 6. Elevations are approved as shown. 7. The applicant shall explore the feasibility of using solar energy to heat all swimming pools. 8. Exterior lighting plans and sign program shall be submitted for Design Review Board process approval prior to the submittal of plans for build- ing permits. All requirements of the final approval shall be made as a part of construction. 9. Construction plans shall be submitted for approval to the City Fire Marshall prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. All units located within 150 feet of the property line along Highway 74 shall be limited to single story in height. 11. Final landscape drawings are not approved at this time. Said plans shall be subject to approval of the Design Review Board prior to occupancy. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
