HomeMy WebLinkAboutRes No 254PLANNING COMMISSION RESOLUTION NO. 254 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROV- ING A DEVELOPMENT PLAN TO ALLOW A SHOPPING CENTER ON PROPERTY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF EL PASEO AND HIGHWAY 111. CASE NO. CUP 08-77. WHEREAS, pursuant to the provisions of the Palm Desert Zoning Code, the Planning Commission did on July 5, 1977, hold a duly noticed public hearing to con- sider the application of HOWARD B. LAWSON for approval of a development plan to allow a shopping center on property located in the P-C, S.P. Zone and situated at the southeast corner of intersection of El Paseo and Highway 111 and more par- ticularly described as: APN 629-7200.16-4 APN 629-7200.16-5 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that the Director of Environmental Services has determined that the project is exempt from the requirements of CEQA due to its location within the Redevelopment Area, and; WHEREAS, at said public hearing, upon hearing and considering all testi- mony and argument, the Planning Commission did find the following facts and reasons to exist to justify -the granting of approval of said Development Plan: 1. Proposed development as amended by the conditions of approval will conform to the intent and purpose of the PC Zone District; 2. Proposed development as amended by the conditions of approval will conform to the adopted General Plan; 3. Proposed development as amended by the conditions of approval will conform to the Redevelopment Plan, and; WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, the Planning Commission did find the proposed development to be in conformance with the City's adopted Redevelopment Plan; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. Approval of the Development Plan is granted to HOWARD B. LAWSON for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the City of Palm Desert Planning Commission held on July 5, 1977 by the following vote, to wit: AYES: Kryder, Snyder, Kelly, Berkey, Reading NOES: None ABSENT: None ABSTAIN: None GEOR E BERKEY, Chairma ATTEST: PAUL A. WILLIAMS, Secretary Planning Commission Resolution No. 254 July 5, 1977 CONDITIONS OF APPROVAL CASE N0. CUP 08-77 1. The development of the property shall conform substantially with that as shown on plot plan marked Exhibit 'A-1' and related Exhibit B on file with the Depart- ment of Environmental Services, Case No. CUP 08-77, unless otherwise amended by the following conditions. The plot plan marked Exhibit A is hereby denied. 2. Prior to the issuance of a building permit for construction of any use contem- plated by this approval, the applicant shall first obtain permits and/or clear- ance from the following public agencies: County Department of Public Health City Engineer - City of Palm Desert Palm Desert Design Review Board Process City Fire Marshal - City of Palm Desert Coachella Valley County Water District Regional Water Quality Control Board #7 Evidence of said permit or clearance from the above agencies shall be persented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 3. Install City Standard curb, gutter, tie-in paving and sidewalk along full front- age where not already existing. 4. Modify El Paseo median as required by City Engineer to provide for access. Pre- cise access locations shall be subject to approval of the City Engineer. 5. Details of access to Highway 111 shall be subject to approval of Caltrans and the City Engineer. 6. Applicant shall agree to participate in 1/8 of the cost of a 4-leg traffic sig- nal at El Paseo and Highway 111. Form of the agreement shall be subject to ap- proval of the City Attorney. 7. Applicant shall install safety lighting on all frontages if required by the City Engineer. (NOTE: This may not be required if center lighting does this job.) 8. Driveways on El Paseo shall have minimum 35 foot width. Design of internal cir- culation shall be subject to approval of City Traffic Engineer. 9. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Process. The build- ing permit when issued shall include the grading, lighting, amenities, trash storage, walkways, and irrigation systems. No final inspection shall be given by the Department of Environmental Services to this project until the aforemen- tioned approved plans and construction shall have been completed. 10. The Fire Protection Requirements as specified in the Fire Marshal's memo dated June 21, 1977, attached hereto, shall apply, with the exception of Condition #6. 11. Construction of the development permitted hereby shall be done as a single project. 12. The sewerage disposal system shall be submitted to and approved by the Coachella Valley County Water District prior to issuance of a building permit. 13. Construction shall commence within one (1) year after final approval, otherwise said approval shall become null and void and of no effect whatsoever. 14. Prior to the issuance of any permits, the applicant shall agree in writing to any conditions of approval. 15. The development of the property described herein shall be subject to the res- trictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. All new and existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are adjacent to and provide service to the property being developed shall be installed under- ground as a part of developmetn from the nearest existing pole not on the property being developed. 17. Service access shall be provided to potential stores including required loading areas. 18. An additional planter area shall be provided at the northeast corner of the property between Highway 111 and required opening to existing development to the east. 19. Applicant shall relocate and provide tree well locations to the corner of the intersection of four parking spaces. 20. Applicant shall relocate proposed free standing building to abut proposed landscape area at the intersection of El Paseo and Highway 111. 21. Applicant shall gradually increase planter width west of proposed opening to Highway 111 to 40' within 250 ft. of the intersection of E1 Paseo and Highway 111 22. Building design shall be modified to reflect the existence of major gas line on property. 23. Applicant shall develop and provide a preliminary sign program for total project. 24. Pedestrian walkways shall be of a similar material to that used in the interior courtyards and the development to the east. 25. A portion of the pedestrian walkway which extends from the east side of the development easterly to the development to the east shall be designated as a bike path. Another bike path shall be provided from the mall area on the west side connecting it with El Paseo where it intersects with Highway 111. Bike racks shall be provided on both the east and west sides of the mall to serve both portions of the development. 26. The number, type, size and location of trees are not approved. Such approval shall be granted through the Design Review Board Process. 27. The applicant shall give particular emphasis to mounding adjacent to El Paseo and Highway 111. 28. Areas adjacent to the parking lot reserved as fire protection areas shall be designated as such in a manner subject to approval through the Design Review Board Process. 29. All driveways shall be center striped due to the two-way circulation. 30. The applicant shall provide the Design Review Process with a plan of expected uses to be considered by the Process before approving any reduction in parking from that required by the Zoning Ordinance. 31. Any possible line -of -sight problems shall be resolved through the Design Review Board Process during their preliminary and final review. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
