HomeMy WebLinkAboutRes No 257PLANNING COMMISSION RESOLUTION NO. 257 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW A RACQUET BALL AND HEALTH CLUB ON PROPERTY GENERALLY LOCATED AT THE NORTHWESTERLY CORNER OF THE INTERSECTION OF PAINTER'S PATH AND HIGHWAY 111. CASE NO. CUP 09-77 WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on July 5, 1977, hold a duly noticed public hearing to consider an application from PALM DESERT RACQUET BALL & HEALTH CLUB, INC., for a Conditional Use Permit to allow a racquet ball and health club facility on pro- perty located in the C-1,S.P. Zone and situated at the northwesterly corner of the intersection of Painter's Path and Highway 111, and more particularly described as: APN 621-301-012 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that the Director of Environmental Services has determined on June 27, 1977 that the project would not have a significant impact on the environment and the appeal period did expire on July 5, 1977; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find the proposed development to be in conformance with the City's adopted Redevelopment Plan; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Com- mission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detri- mental to the public health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 2. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 3. The proposed conditional use complies with the goals, objectives, and policies of the City's adopted General Plan. 4. The proposed conditional use complies with the goals, objectives, and policies of the City's adopted Redevelopment Plan. CASE NO. CUP 09-77 PLANNING COMMISSION RESOLUTION NO. 257 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That the Conditional Use Permit (CUP 09-77) is hereby granted to PALM DESERT RACQUET BALL & HEALTH CLUB, INC., for reasons subject to the attached conditions. WILLIAMS, SECRETARY PALM DESERT PLANNING COMMISSION Planning Commission Resolution No. 257 CONDITIONS OF APPROVAL CASE NO. CUP 09-77 July 5, 1977 1. The development of the property shall conform substantially with that as shown on plans marked Exhibits (A-B) on file with the Department of Environmental Services, Case No. CUP 09-77, unless otherwise amended by the following conditions. 2. The development and use of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all requirements, limitations, and restrictions of all municipal ordi- nances and State and Federal statutes now in force, or which hereafter may be in force. 3. All conditions required as a part of future review shall have equal force and effect on those approved at time of original approval. 4. The proposed structure shall be recessed or bermed as required through the Design Review Process. 5. Wherever feasible, berming shall occur to reduce the impact of the building. 6. The proposed driveway to parking areas shall be reduced to twenty (20) feet and the additional five (5) feet shall be placed adjacent to the building and landscaping in that area shall be substantial to reduce the impact of the building. 7. The texture of the building shall be made more distinctive and more evident. 8. All roof vents shall be recessed. 9. Developer shall install improvements for pedestrians, bicycle, and land- scape purposes to the specifications of the City Engineer along the full frontage on Highway 111 and shall be responsible for the maintenance of any landscaping approved for said area. 10. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 11. The applicant shall conform to all requirements and improvements deemed necessary by the City Fire Marshall as indicated in the inter -office memo- randum as attached. 12. A landscaping, grading, lighting, amenities, sign, trash storage, and irrigation plan shall be submitted for the Design Review Process for approval. Final construction plans shall be submitted to the Design Review Board for approval prior to submittal of plans to the Department of Building and Safety for plan check. No final inspection or occupancy certificate shall be given by the Department of Environmental Services until the aforementioned approved plans and construction shall have been completed. Install city standard curb, gutter, sidewalk and tie-in paving as required by City Engineer along full frontage of Highway 111 and Painters Path. 14. Grant City a 25 foot property line radius corner cut-off at intersection of Highway 111 and Painters Path. 15. Install two street lights on Painters Path, as required by the City Engineer. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use per- mitted until this signed confirmation has been received by the Department of Environmental Services. (714) 657-3183 RE: Case No. CUP 09-77 Palm Desert Racquet Ball and Healthclub Prior to construction of any of the proposed buildings, the following con- ditions must be met: 1. Install a water system capable of delivering 4750 GPM fire flow for a four (4) hour duration in addition to domestic or other supply. The com- putation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Depart- ment, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Conditional Use Permit Number CUP 09-77 is in accordance with the requirements prescribed by the Fire Marshal." 5. The total fire flow requirement requested in Number 2 above (4750 GPM) may be reduced by 25% for complete automatic sprinkler protection in ac- cordance with National Fire Protection Association Standard #13. RE: Case No. CUP 09-77 Page 2 6. The fire flow may also be reduced by installation of area separation walls in accordance with Section 505 of the Uniform Building Code.
