PLANNING COMMISSION RESOLUTION NO. 259 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TENTATIVE MAP TO ALLOW FOR DEVELOPMENT OF A 49-LOT SUBDIVISION ON 9.5 ACRES OF LAND, GENERALLY LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF PORTOLA AND SANTA ROSA WAY. CASE NO. TT 10202 WHEREAS, the Planning Commission of the City of Palm Desert, California, did receive a verified application from Tirrie and Rimmer requesting approval of a 49-lot condominium subdivision on 9.5 acres of land, located in the PR-5, N. Zone District and situated southeast of the intersection of Portola and Santa Rosa Way, and more particularly described as: APN 625-040-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that and Environmental Assessment has been made, a Negative Declaration has been issued and the appeal period has expired; and, WHEREAS, the Planning Commission did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does comply with the adopted Paim Desert General Plan; and, WHEREAS, the Planning Commission did find that the subject Tentative Map does substantially comply with the City of Palm Desert Code, and the State of California Subdivision Map Act, as amended. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Paim Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend approval to the City Council of the City of Palm Desert, California, of the above described Tentative Map No. 10202, subject to the fulfillment of the attached conditions of approval. FURTHER, BE IT RESOLVED that the recommended Conditions of Approval do include a recommendation to the City Council that they require compliance to Article 26.15 of the City's Subdivision Ordinance by the payment of a fee as specified by recommended Standard Condition of Approval No. 17. WILLIAMS, Secretary '------"\ GEURGE BERKEY, Chairman l PLANNING COMMISSION RESOLUTION NO. 259 JULY 5, 1977 CONDITIONS OF APPROVAL CASE N0. TRACT 10202 I. STANDARD CONDITIONS: 1. Full public improvements including traffic safety lighting on Portola shall be installed to City Standards as required by Ordinance and the City Engineer. 2. Access rights on Portola shall be offered to the City as a dedication on the Final Map. 3. Prior to submittal of the Final Map, the applicant shall provide the City with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. 5. The C. C. & R's for this development shall be submitted to the City Attorney for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the appli- cant shall submit to the Director of Environmental Services the following documents which shall demonstrate to the satisfaction of the Planning Commission that the total project will be developed and maintained in accordance with the intent and purposes of the approval: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into within the owners of .the units of the project. 6. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 7. The water system shall be signed by a registered civil engineer and ap- proved by the water company, with the following certification: "I certify that the design of the water system of Tract No. 10202 is in accordance with the requirements prescribed by the City Fire Marshal." 8. Improvement plans for water and sewer system shall meet the requirements of the respective service districts. 9. All on -site utilities, including cable. TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required for checking and approval, before construction of any improvements is com- menced. The subdivider shall submit the original drawings reviewed to reflect as -built conditions, prior to acceptance of the subdivision im- provements by the City or Special District. 11. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 12. Area shall be annexed to Improvement Districts No. 54 and No. 80 of the Coachella Valley County Water District. PLANNING COMMISSION RESOLUTION NO. 259 CONDITIONS OF APPROVAL CASE NO. TT 10202 13. In compliance with Article 26.15 of the City's Subdivision Ordinance, the public facilities requirement shall be met by the paying of a fee in an amount determined under the Ordinance provisions. 14. All requirements of the Planning Commission action on the Development Plan known as Case No. DP 08-77 shall be met as a part of the develop- ment of this tract. 15. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineering data as requested. 16. A11 private streets shall be inspected by the Engineering Department and a Standard Inspection Fee shall be paid. II. SPECIAL CONDITONS: 1. The total number of lots shall be limited to forty-nine (49). 2. All requirements of the City Fire Marshal for the Development Plan known as Case No. DP 08-77 shall be met as a part of the development of this tract. 3. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. Street width shall be 40' curb -to -curb in a 50' right-of-way. The street pattern in the area east of Lot 49 shall be revised in a manner acceptable to the City Engineer. The said Tentative Map shall be re- vised and submitted as a Revised Tentative Map pursuant to the Sub- division Ordinance. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use per- mitted until this signed confirmation has been received by the Department of Environmental Services. CALIFORNIA 92370 TELEPHONE (714) 657-3183 Prior to construction of any of the proposed buildings, the following con- ditions must be met: 1. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The com- putation shall be based upon a minimum of 20 psi residual operating pres- sure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 08-77 is in accordance with the requirements prescribed by the Fire Marshal."
