HomeMy WebLinkAboutRes No 266PLANNING COMMISSION RESOLUTION NO. 266 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR A CHANGE OF ZONE FROM PR-3 TO R-1-10,000 ON PROPERTY GENERALLY LOCATED NORTH OF HAYSTACK ROAD WEST OF PORTOLA AVENUE. CASE NO. C/Z 07-77 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of July, 1977, hold a duly noticed Public Hearing and a continued Public Hearing on August 2, 1977 to consider a Change of Zone application, filed by G. GRAZIADIO from PR-3 (Planned Residential - three units to the acre) to Single -Family Residential (R-1-10,000) on property generally located northerly of Haystack Road west of Portola Avenue and more particularly described as: APN 630-250-017 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration determination was made by the Director of Environmental Services and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the denial of the Change of Zone necessary to carry out the provisions and general purpose of the Palm Desert Zoning Ordinance: 1. Proposed zone would not foster a harmonious workable relationship with the land uses adjacent to the property being considered on the basis that the development as R-1 lots would not be compatible to the exist- ing development to the north, possible development of property to the west, the potential public park site to the east, or the traffic on Haystack Road. 2. Development of the proposed property under the existing zoning would seem to be the most appropriate and most beneficial to the City as a whole. 3. The requested zoning would increase the density which does not appear appropriate for the size, shape, and configuration of the property under consideration. 4. Increased density on the property in question does not appear consistent with sound standards of public health and safety from the standpoint of the property being located adjacent to a major traffic carrier. 5. The proposed aming would not appear to provide for adequate privacy and open space for the ultimate dwellings on the property. 6. The proposed re -zoning would increase traffic congestion in the area. The proposed re -zoning would result in an increase in hazards and noise congestion for the ultimate residents. 7. The proposed re -zoning would result in an increase in noise, odors, dust, dirt, and other objectionable influences on the ultimate occupants of dwellings on the property. 8. The proposed re -zoning would not encourage superior site planning and environmental design. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: PLANNING COMMISSION RESOLUTION NO. 266 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the Planning Commission of the City of Palm Desert does hereby deny the requested Change of Zone from PR-3 (Planned Residential) to(R-1-10,000) Single -Family Residential for the reasons set out in this resolution. PASSED, APPROVED and ADOPTED at a regular meeting of the Planning Com- mission, held on this 2nd day of August, 1977, by the following vote, to wit: AYES: BERKEY, SNYDER, KRYDER NOES: NONE ABSENT: KELLY, READING ABSTAIN: NONE ATTEST: PAUL A.
