A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CON-
DITIONAL USE PERMIT TO ALLOW A 17-UNIT MOBILEHOME SUBDIVISION
ON PROPERTY GENERALLY LOCATED WEST OF HIGHWAY 74 IN THE SILVER
SPUR MOBILE MANOR.
CASE NO. CUP 13-77
WHEREAS, pursuant to the provisions of Article 25.13 of the Palm Desert
Zoning Ordinance, the Planning Commission did on August 30, 1977, hold a duly noticed
public hearing to consider the application of SILVER SPUR MOBILE MANOR for a Con-
ditional Use Permit to allow a 17-unit mobilehome subdivision, an additional phase
of the Silver Spur Mobile Manor on property located in the R-M Zone and situated west
of Highway 74 and in the Silver Spur Mobile Manor and more particularly described as:
APN 631-150-01
WHEREAS, said application is exempt from the requirements of the "City of
Palm Desert Environmental Quality Procedure Resolution Number 77-7", in that an
Environmental Impact Report was accepted on September 13, 1973 for a similar project
on this site and no major changes have occured to justify additional environmental
documentation, and;
WHEREAS, at said public hearing, upon hearing and considering all testimony
and argument, the Planning Commission did find the following facts and reasons to
exist to justify the granting of said Conditional Use Permit.
1. That the proposed location of the conditional use is in accord with the
objectives of the Zoning Ordinance and the intent and purpose of the R-M
District.
2. That the proposed location of the conditional use and the conditions under
which it would be operated and maintained will not be detrimental to the
public health, safety, or welfare, or be materially injurious to properties
or improvements in the vicinity.
3. That the proposed conditional use will comply with each of the applicable
provisions of the Zoning Ordinance.
4. That the proposed conditional use complies with the goals, objectives
and policies of the Palm Desert General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert as follows:
1. That the above recitations are true and correct and constitute the find-
ings of the commission in this case.
2. That a Conditional Use Permit is granted to SILVER SPUR MOBILE MANOR
subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the City of Palm Desert
Planning Commission held on August 30, 1977 by the following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 13-77
1. The development of the property shall conform substantially with that as
shown on Plot Plan marked Exhibit A on file with the Department of Environ-
mental Services, Case No. CUP 13-77, unless otherwise amended by the follow-
ing conditions.
2. Prior to the issuance of a building permit for construction of any use con-
templated by this approval, the applicant shall first obtain permits and
clearance from the following public agencies:
Department of Public Health
Department of Public Works
Palm Desert Design Review Board
Palm Desert City Fire Marshal
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be presented
to the Building and Safety Department at the time of the issuance of a building
permit for the use contemplated herewith.
3. A preliminary landscaping, grading, lighting, amenities, trash storage, walkway
layout, signage, and irrigation plan shall be submitted through the Design
Review Board process for approval prior to issuance of building permits.
4. The sewage disposal system shall be submitted to and approved by the Coachella
Valley County Water District prior to issuance of a building permit.
5. This approval shall be used within one year, otherwise it shall become null and
void.
6. All utility distribution service lines within or adjacent to the subject property
shall be placed underground.
7. A six (6) foot decorative masonry wall or alternate as approved by the Design
Review Board process shall be installed along the complete frontage of the north
and west property lines. All other fencing shall be approved by the Design
Review Board process.
8. The applicant shall comply with any laws, regulations, and requirements of the City
of Palm Desert, the State of California or any other applicable government agency
as a part of construction.
9. Construction of all private streets shall be inspected by the Engineering Depart-
ment and a standard fee shall be paid.
10. Install Riverside County Standard Fire Hydrants, located at intersections so
no mobile home is more than 250 feet from a hydrant.
11. Fire hydrants shall be installed on approved looped water mains as follows:
a. A minimum of 6 inch diameter to serve all buildings and recreational vehicle
storage lots.
12. Provide the following fire flows for a two (2) hour duration in addition to domestic
or irrigation supply. All computations shall be based upon a minimum of 20 psi
residual operating pressure in the supply main from which the flow is measured
at the time of measurement.
a. 500 GPM to serve all buildings and mobile homes.
b. 500 GPM to serve recreational vehicle storage lot.

13. Prior to issuance of building permits, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
14. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the
design of the water system in CUP 13-77 is in accordance with the requirements
prescribed by the Fire Marshal". Upon approval, the original plan will be return-
ed to the developer.
15. The subject site shall be annexed to Improvement District Nos. 54 & 80 of the
C.V.C.W.D for sanitation service and to the Coachella Valley Stormwater Unit of
the C.V.C.W.D.

The applicant shall engineer, and provide for drainage facilities necessary
to handle runoff waters along the northerly boundary of this subdivision
to the satisfaction of the City Engineer.
17. In conformance with the Zoning Ordinance requirement, applicant shall provide a
minimum of 6800 square feet of community use area, the location of which is to
be approved by staff.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand the Department of Building and Safety will
not issue a building permit or allow occupancy on the use permitted until this signed
confirmation has been received by the Department of Environmental Services.
