HomeMy WebLinkAboutRes No 279PLANNING COMMISSION RESOLUTION NO. 279 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A REQUEST FOR A CHANGE OF ZONE ON PROPERTY GENERALLY LOCATED SOUTH OF ELPASEO, NORTH OF SHADOW MOUN- TAIN DRIVE, EAST OF LUPINE LANE, AND WEST OF SUN LODGE LANE. CASE NO. C/Z 06-77 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 30th day of August, 1977, hold a duly noticed Public Hearing to consider a Change of Zone application filed by C. G. DUNHAM, from PR-6 to C-1, S.P. and R-3(4) on property generally located south of El Paseo, North of Shadow Mountain Drive, East of Lupine Lane and West of Sun Lodge Lane, and more particularly described as: APN 627-252-003-3 APN 627-252-002-2 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration determination was previously made by the Director of Environmental Services for Case No. RPA 03-77, a related case, and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist which make the approval of the Change of Zone necessary to carry out the provisions of the Palm Desert General Plan: 1. The Change of Zone does conform to the Palm Desert General Plan. 2. The Change of Zone will not adversely affect the health, safety, and general welfare of the community. 3. The Change of Zone does conform to the Palm Desert Redevelopment Plan for Project Area No. 1. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend approval to the City Council of the requested Change of Zone from PR-6 to C-1, S.P. and R-3(4) as indicated in Exhibit A, for reasons set out in this resolution. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 30th day of August, 1977, by the following vote, to wit: AYES: BERKEY, SNYDER, KRYDER, KELLY NOES: READING ABSENT: NONE ABSTAIN: NONE GEORGE BERKEY, Chairman ATTEST: PAUL A.
