HomeMy WebLinkAboutRes No 280PLANNING COMMISSION RESOLUTION NO. 280 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING ITS FINDINGS AND UPHOLDING THE DECISION OF THE DESIGN REVIEW BOARD TO DENY THE APPEAL OF DR. SANTIAGO FERNANDEZ OF SPECIFIC CONDITIONS OF APPROVAL FOR CASE NO. 303SF. WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the conditions of approval for Case No. 303SF, and more specifically: Condition No. 6 which requires the applicant to submit a revised landscaping plan to the Department of Environmental Services prior to submittal of plans to the Department of Building and Safety for plan check; Condition No. 8 which requires the driveway to be constructed of concrete; Condition No. 10 which requires the front garden wall to be con- structed of slumpstone; Condition No. 13 which requires the parkway to be landscaped; and, WHEREAS, the Planning Commission did review the Design Review Board's reasons for denying the appeal of Conditions No. 6, 8, 10, 13; and, WHEREAS, after hearing all the testimony regarding this matter did find the following facts to exist to justify upholding the findings of the Design Review Board and denying the appeal with regard to Conditions Nos. 6 and 13: 1. Condition Nos. 6 and 13 of Case No. 303SF are consistent with the objectives of the Design Review Board process stated in Sec. 25.39-201 of the Zoning Ordinance; 2. Condition Nos. 6 and 13 are not unreasonable in light of the City's objectives to use the Design Review Board process as a means of encouraging private interests to assist in the implementation process of the City's General Plan and exercise reasonable controls over the character and design of buildings to assure protection of public benefits derived from expenditures of public funds for im- provement and beautification of the city. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. The requested appeal is hereby denied for Condition Nos. 6 and 13. 3. The appeal for Conditions Nos. 8 and 10 is hereby upheld. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Plan- ning Commission, held this 30th day of August, 1977, by the following vote, to wit: AYES: BERKEY, KRYDER, SNYDER, KELLY, READING NOES: NONE ABSENT: NONE ABSTAIN: NONE GEORGE BERKEY, Chairman ATTEST: PAUL A.
