HomeMy WebLinkAboutRes No 287PLANNING COMMISSION RESOLUTION NO. 287 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW A PARKING LOT IN THE R-3(4) ZONING DISTRICT ON PROPERTY GENERALLY LOCATED SOUTH OF EL PASEO AND WEST OF SUN LODGE LANE. CASE NO. CUP 06-77 WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on October 4, 1977, hold a duly noticed public hearing to consider the application of C. G. DUNHAM for a Conditional Use Permit to allow a parking lot to be constructed and maintained on property located in the R-3(4) Zone and situated south of El Paseo and west of Sun Lodge Lane and more particularly described as: APN 627-252-003-3 APN 627-252-002-2 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that an Environmental Assessment form was submitted and a Negative Declaration determination was previously made by the Director of Environmental Services for Case No. RPA 03-77, a related case, and the appeal period has expired; and, WHEREAS, at said public hearing, upon hearing and considering all testimony and argument, the Planning Commission did find the follow- ing facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the condition under which it would be operated and maintained will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinty. 3. The proposed conditional use complies with the goals, objec- tives, and policies of the City's adopted General Plan. 4. The proposed conditional use complies with the goals, objec- tives and policies of the City's adopted Redevelopment Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. This action is contingent upon Council approval of the proposed R-3 Zone designation of the property. 3. That the Condtional Use Permit CUP 06-77 is hereby granted to C. G. DUNHAM for reasons subject to the attached conditions.' WILLIAMS, Secretary GEORGEERKEY, Chai man /ks CONDITIONS OF APPROVAL CASE NO. CUP 06-77 PLANNING COMMISSION RESOLUTION NO. 287 1. A Conditional Use Permit for a 146 space parking lot related to proposed com- mercial development is granted for the lands as described in the application and any attachments thereto, and as shown on the Plot Plan labeled Exhibit B. 2. Unless the use is inaugurated not later than one year after the date the approval is granted and is diligently pursued thereafter, this approval will automatically become null and void. 3. Any minor change may be approved by the Director of Environmental Services. Any substantial change will require the filing of an application for an amendment to be considered by the Planning Com- mission. 4. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with. 5. No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been reviewed and approved by the Department of Environmental Services. 6. Prior to obtaining a building permit, the applicant shall file with the Director of Environmental Services written acceptance of the conditions stated herein. 7. Compliance with an execution of all conditions listed hereon shall be necessary, unless otherwise specified, prior to obtaining final building inspection clearance. Deviation from this requirement shall be permitted only by written consent of the Director of Environmental Services. 8. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following: County Department of Public Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley County Water District Evidence of said permit shall be presented to the Building and Safety Department prior to the issuance of any building permit. 9. Any and all lighting of parking areas for safety purposes shall be provided for as approved by the Design Review Board. 10. Traffic control provisions shall be provided as required by the Design Review Board and the City Engineer. 11. Applicant agrees to join any assessment district formed that includes the subject property within its boundaries. 12. A landscaping, grading, fencing, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Board process. No final inspection shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been com- pleted. 13. The applicant shall underground all existing overhead utility dis- tribution lines on or immediately adjacent to the subject parcel pursuant to the provisions of the Zoning Ordinance. PLANNING COMMISSION RESOLUTION NO. 287 PAGE TWO SPECIAL CONDITIONS 1. Ingress and egress on both Sun Lodge Lane and Lupine Lane shall be limited to one entrance on each street. 2. Right-of-way dedications shall be as needed for Sun Lodge exten- sion and for redevelopment requirements. 3. Plantings shall be limited at all entrances to enable full sight distance in either direction. 4. Tree wells shall be provided throughout the commercial parking lot. 5. A six (6) foot masonry wall or equivalent, shall be constructed along the south border of the project. 6. Where the parking area is situated across the street from property in a residential district along Lupine Lane and Sun Lodge Lane, a masonry wall or berm (3) feet in height shall be erected within the required landscape area to adequately screen the residential pro- perties. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
