HomeMy WebLinkAboutRes No 296PLANNING COMMISSION RESOLUTION NO. 296 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A DEVELOPMENT PLAN AND PRELIMINARY DESIGN REVIEW TO ALLOW 168 HOTEL UNITS, ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF HIGHWAY 111, WEST OF THE PALM DESERT CITY LIMITS. CASE NO. DP 11-77B and 92MF. WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission did on November 1, 1977, hold a duly noticed public hearing to consider an application from AFFILIATED CON- STRUCTION CO., INC. for approval of a Development Plan to allow 168 hotel units, on property located in the P.C.(4), S.P. and situated south of Highway 111 and west of the Palm Desert City Limits and more parti- cularly described as: APN 625-15-004-5 and north 3.94 4- acre portion of APN 625-15-005-6 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 77-7", in that the Director of Environmental Services has determined that the project would not have a significant impact on the environment and the appeal period did expire on October 21, 1977; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard including the Design Review Board's recommendations, said Com- mission did find the following facts and reasons to exist to justify the approval of the subject Development Plan: 1. The proposed development is consistent with the City's adopted General Plan. 2. The design or improvement of the proposed development will be consistent with the Palm Desert Zoning Ordinance. 3. The proposed development is consistent with the land use element of the Palm Desert Redevelopment Plan. 4. The site is physically suited for both the type of develop- ment proposed and the proposed density. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of City of Palm Desert as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. That approval of Development Plan DP 11-77B is hereby recom- mended to the City Council for reasons subject to the attached conditions. 3. The attached conditions include the Design Review Board recom- mendations from their meeting of October 25, 1977, which have been includ- ed as recommended conditions of approval. WILLIAMS, /ks CONDITIONS OF APPROVAL DP 11-77B PLANNING COMMISSION RESOLUTION NO. 296 I. STANDARD CONDITIONS Page Two 1. The development of this project shall conform substantially to all plans submitted in behalf of this case (ExhibitsA&C), and as revised according to the Design Review Board rpocess and/or Planning Commission Action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. Any roof mounted, exhaust, or air conditioning equipment shall be fully concealed from view from any public rights -of -way and adjoining properties by architecturally integrated means. 5. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All condi- tions shall be made a part of construction and no certificate of occupancy shall be issued until completed. Note Fire Marshal's letter dated October 19, 1977 attached hereto for requirements. 6. All utility service and distribution lines on or abutting the subject property, shall be placed undergound prior to occupancy clearance. 7. Traffic control provisions shall be provided as required by the City Engineer. 8. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the City Engineer. 9. A landscaping, grading, lighting, amenities, trash storage, walk- way layout, and irrigation plan shall be submitted through the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construc- tion shall have been completed. 10. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 11. Plans and specifications shall conform to the City of Palm Desert standard specifications, development procedures and design criteria. Any modifications, thereof, shall require approval of the City Engineer. PLANNING COMMISSION RESOLUTION NO. 296 CASE NO. DP 11-77B II. SPECIAL CONDITIONS A. General 1. Approval is hereby limited to 168 hotel units. Page Three 2. The proposed development shall have a master trash disposal agreement acceptable to the Palm Desert Dis- posal Company. If said agreement includes trash en- closures, said enclosures shall be to City Standards and subject to review by the DRB as a part of the construc- tion drawings. 3. Modifications to off -site streets shall be made to pro- vide for egress and ingress satisfactory to the City Engineer. 4. Drainage facilities shall be provided satisfactory to the City Engineer. B. Hotel Facilities (Exhibit A) 1. If the proposed hotel units are to be sold to separate individuals, the applicant shall provide, as a part of the tentative tract application, proposed covenents, con- ditions and restriction a limitation of a maximum of thirty (30) consecutive days of occupancy by the owner and/ or leasor of any unit. 2. The proposed landscape area adjacent to the proposed exten- tion of the frontage road shall be increased to a minimum of 20 feet in width. 3. A 6 ft. high decorative block wall shall be provided on the east, south and west boundary lines of the proposed hotel complex. Said wall shall be extended along the north bound- ary of the project setbacks 15 feet from the proposed property line with the following exceptions: a. at approved entrances, said wall shall be reduced to a maximum height of three feet or held back a sufficient distance to guarantee adequate sight distance. 4. The proposed tennis courts shall be recessed a minimum of three feet and shall not be lighted except under the follow- ing limitations: a. any proposed lighting system shall be subject to the approval of the DRB as a part of review of the construc- tion drawings. b. the landscape treatment around the proposed tennis courts shall consist of tall trees to reduce side glare. 5. The proposed east -west driveways adjacent to the north bound- ary of the project shall be limited to 20 feet in width. 6. The proposed parking shall be increased to a total of 219 spaces by making these changes to the proposed plot plan: a. move the eight unit portion of the two southerly most, east -west oriented building fifteen feet to the north and add six spaces to the parking bays at the rear of said buildings. b. add two spaces at each end of the parking area on the southerly boundary of the complex. Page Four 6. c. add a total of four spaces to the parking bays located on the entrance driveway to the complex. d. add one space to the parking areas located in the northeast and northwest corners of the project. e. the proposed entrance street shall be widened to 32 ft. adjacent to the tennis courts to provide for parallel parking adjacent to the courts. C. Design Review Conditions (Case No. 92MF) 1. The proposed roof line for the Hotel buildings shall be restudied to better tie it into the design of the building. 2. Different material should be utilized for the fencing adjacent to the patio areas for the hotel units. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand the Depart- ment of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
