A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS
AND APPROVING A TENTATIVE PARCEL MAP AND RELATED VAR-
IANCE FOR LOT SIZE REDUCTION FOR 1.32 ACRES OF LAND
LOCATED AT THE SOUTHWEST CORNER OF CATALINA AND SAN
PASCUAL.
CASE NO. PM 11390
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did receive a verified application from PASQUAL PROPERTIES,
LTD. requesting approval of a lot split of 1.32 acres of land, situated
in the R-1 18,000 Zone District and located at the southwest corner of
Catalina and San Pascual, more particularly described as:
APN 627-114-04
WHEREAS, the Planning Commission did also receive a verified
application from PASQUAL PROPERTIES, LTD., requesting approval of a
related Variance for lot size reduction from the required 18,000 sq.
ft. minimum lot area to 17,587 sq. ft. for the three lots to be created
from the division of the above described parcel; and,
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 77-7", in that the Director of Environmental Services has deter-
mined that the project will not have a significant adverse impact on
the environment and no further environmental documentation will be re-
quired and the appeal period has expired; and,
WHEREAS, the Planning Commission did take into consideration
the Tentative Parcel Map as submitted, and the reports of the various
reviewing agencies; and,
WHEREAS, the Planning Commission did find that the subject
Tentative Parcel Map does substantially comply with the City of Palm
Desert Municipal Code and the State of California Subdivision Map Act,
as amended; and,
WHEREAS, the Planning Commission did find that the subject
Tentative Parcel Map does comply with the adopted General Plan; and,
WHEREAS, the Planning Commission has determined that the
granting of a Variance for lot size reduction will not be detrimental to
the public health, safety or general welfare, or be materially injurious
to properties or improvements in the vicinity: the strict interpretation of
the lot size requirement will deprive the applicant of privileges enjoyed
by the owners of other properties in the same vicinity and zone and the
strict interpretation of the lot size requirment will result in practical
difficulty and unnecessary hardship inconsistent with the objectives of
the Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are ture and correct and con-
stitute the findings of the Commission in this case;
2. That it does hereby approve the above described Tentative
Parcel Map No. 11390, subject to the fulfillment of the attached con-
ditions;
3. That it does hereby approve a Variance for lot size reduc-
tion to permit the creation of three (3) 17,587 sq. foot lots where a
minimum of 18,000 sq. ft. of lot area is required.

Commission, on this 29thday of November, 1977, by the following vote,

1. The tentative Parcel Map is granted for the land as described in
the application and any attachments, thereto, and as shown on the
plot plan labeled, Exhibit A, and the requirements herein.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of any construction.
3. Applicant shall dedicate five (5) feet of public easement
along San Pasqual Avenue and along Catalina St. with a 15' corner
"cut off" at the intersection.
4. Applicant shall install full public improvements along both front-
ages including sidewalks and a catch basin on San Pasqual.
5. The applicant shall comply with all current Palm Desert Community
Services District Ordinances, particularly Ordinance No. 13 per-
taining to new development.
6. The applicant shall submit an engineered water plan to the Palm
Desert Community Services District for approval.
7. The applicant shall extend the water main from a point approximately
325 feet south of the centerline of Catalina Way, north 350 feet to
join the existing water main in Catalina Way if required by the
Palm Desert Community Services District.
8. Applicant shall install or show exists a water system capable of
delivering 500 GPM fire flow from any fire hydrant for a two hour
duration in addition to domestic supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the
supply main from which the flow is measured at the time of measure-
ment.
9. Applicant shall install a Riverside County super fire hydrant located
on the southwest corner of San Pasqual and Catalina.
a. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and the tops and nozzle caps shall be painted red.
b. Curbs, if installed shall be painted red 15 feet in either di-
rection from each hydrant.
10. Prior to recordation of the final map, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review.
11. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I hereby certify that the design of the water system in Parcel No.
11390 is in accordance with the requirements prescribed by the Fire
Marshal." Upon approval, the original plan will be returned to the
developer.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand the Department of
Building and Safety will not issue a building permit or allow occupancy
on the use permitted until this signed confirmation has been received
by the Department of Environmental Services.
